AIIMS Students Union vs AIIMS Case Summary AIR 2001 SC 3262
In the case of AIIMS Student Union vs AIIMS Supreme Court of India speaking about the importance of Fundamental Duties enshrined in Article 51A while striking down the institutional reservation of 33% in AIIMS coupled with 50% reservation discipline wise as violative of Article 14 of the Constitution of India.
Supreme Court said that they are equally important like Fundamental Rights. Though Fundamental Duties are not made enforceable like Fundamental Rights but it cannot be overlooked as duties in Part IV A is prefixed by the same word 'Fundamental' which was prefixed by the founding fathers of the Constitution to 'right' in Part III.
