Section 9 The Arms Act, 1959 in Hindi and English 

Section 9 The Arms Act, 1959:(1) Notwithstanding anything in the foregoing provisions of this Act,―

(a) no person,―

(i) who has not completed the age of twenty-one years, or

(ii) who has been sentenced on conviction of any offence involving violence or moral turpitude to imprisonment for any term, at any time during a period of five years after the expiration of the sentence, or

(iii) who has been ordered to execute under Chapter VIII of the Code of Criminal Procedure, 1973 (2 of 1974), a bond for keeping the peace or for good behaviour, at any time during the term of the bond,

shall acquire, have in his possession or carry any firearm or ammunition;

(b) no person shall sell or transfer any firearm or ammunition to, or convert, repair, test or prove any firearm or ammunition for, any other person whom he knows, or has reason to believe —

(i) to be prohibited under clause (a) from acquiring, having in his possession or carrying any firearm or ammunition, or

(ii) to be of unsound mind at the time of such sale or transfer, or such conversion, repair, test or proof.

(2) Notwithstanding anything in sub-clause (i) of clause (a) of sub-section (1), a person who has attained the prescribed age-limit may use under prescribed conditions such firearms as may be prescribed in the course of his training in the use of such firearms:

Provided that different age-limits may be prescribed in relation to different types of firearms.

आयुध अधिनियम, 1959 की धारा 9 का विवरण :  -  (1) इस अधिनियम के पूर्वगामी उपबंधों में किसी बात के होते हुए भी -

(क) कोई भी व्यक्ति -

(i) जिसने इक्कीस वर्ष की आयु पूरी न की हो ; अथवा

(ii) किसी ऐसे अपराध की दोषसिद्धि पर जिसमें हिंसा या नैतिक अवचार अन्‍तर्वलित हो किसी अवधि के लिए कारावास से दण्डादिष्ट किया गया हो, उस दण्डादेश के अवसान के पश्चात्‌ पांच वर्ष की कालावधि के दौरान किसी भी समय ; अथवा

(iii) जिसे दण्ड प्रक्रिया संहिता, 1973 (1974 का 2) के अध्याय 8 के अधीन परिशान्ति कायम रखने या सदाचार के लिए बन्धरपत्र निष्पादित करने का आदेश दिया गया हो, उस बन्धपत्र की अवधि के दौरान किसी समय,

कोई अग्न्यायुध या गोलाबारूद अर्जित नहीं करेगा, अपने कब्जे में नहीं रखेगा और न वहन करेगा ;

(ख) कोई भी व्यक्ति किसी अग्न्यायुध या गोलाबारूद विक्रय या अंतरण ऐसे अन्य व्यक्ति को नहीं करेगा और न किसी अग्न्यायुध या गोलाबारूद का संपरिवर्तन, मरम्मत, उसकी परख या परिसिद्धि ऐसे अन्य व्यक्ति के लिए करेगा जिसकी बाबत वह जानता है या वह विश्वास करने का कारण रखता है कि वह -

(i) किसी अग्न्यायुध या गोलाबारूद को अर्जित करने, अपने कब्जे में रखने या वहन करने से खण्ड (क) के अधीन प्रतिषिद्ध है, अथवा

(ii) ऐसे विक्रय या अन्तरण या ऐसे संपरिवर्तन, मरम्मत, परख या परिसिद्धि के समय विकृतचित्त का है।

(2) उपधारा (1) के खण्ड (क) के उपखण्ड (1) में किसी बात के होते हुए भी जिस व्यक्ति ने विहित आयु-सीमा पूरी कर ली है वह विहित शर्तों के अधीन ऐसे अग्न्यायुथों का प्रयोग कर सकेगा जो ऐसे अग्न्यायुधों का उपयोग करने में उसके प्रशिक्षण की चर्या में विहित किए जाएं :

परन्तु विभिन्‍न प्रकार के अग्न्यायुधों के संबंध में विभिन्‍न आयु-सीमाएं विहित की जा सकेंगी ।
