Section 131 The Army Act, 1950  :Oaths of member, judge advocate and witness.

(1) An oath or affirmation in the prescribed manner shall be administered to every member of every court- martial and to the judge advocate before the commencement of the trial.

(2) Every person giving evidence before a court- martial shall be examined after being duly sworn or affirmed in the prescribed form.

(3) The provisions of sub- section (2) shall not apply where the witness is a child under twelve years of age and the court- martial is of opinion that though the witness understands the duty of speaking the truth, he does not understand the nature of an oath or affirmation.

सेना अधिनियम, 1950 की धारा 131 का विवरण :  - सदस्य, जज-एडवोकेट और साक्षी को शपथ दिलाना - (1) इसके पूर्व कि विचारण प्रारंभ हो, हर सेना-न्यायालय के हर सदस्य को और जज-एडवोकेट को विहित रीति से शपथ दिलाई जाएगी या उससे प्रतिज्ञा कराया जाएगा।

(2) सेना-न्यायालय के समक्ष साक्ष्य देने वाले हर व्यक्ति की परीक्षा, विहित प्ररूप में सम्यक् रूप से उसे शपथ दिलाने या प्रतिज्ञान कराने के पश्चात् की जाएगी।

(3) उपधारा (2) के उपबन्ध वहां लागू नहीं होंगे, जहां कि साक्षी बारह वर्ष से कम आयु का बालक है और सेना-न्यायालय की यह राय है कि यद्यपि साक्षी सत्य बोलने के कर्तव्य को समझता है, किन्तु शपथ या प्रतिज्ञान की प्रकृति को नहीं समझता।
