Section 125 The Army Act, 1950  :Choice between criminal court and court- martial. When a criminal court and a court- martial have each jurisdiction in respect of an offence, it shall be in the discretion of the officer commanding the army, army corps, division or independent brigade in which the accused person is serving or such other officer as may be prescribed to decide before which court the proceedings shall be instituted, and, if that officer decides that they should be instituted before a court martial, to direct that the accused person shall be detained in military custody.

सेना अधिनियम, 1950 की धारा 125 का विवरण :  - दण्ड-न्यायालय और सेना-न्यायालय में से किसी एक का चुनाव - जब कि दण्ड-न्यायालय और सेना - न्यायालय में से हर एक किसी अपराध के सम्बन्ध में अधिकारिता रखता है तब यह विनिश्चित करना कि कार्यवाही किस न्यायालय के समक्ष संस्थित की जाए उस सेना, सेना - कोर, डिवीजन या स्वतन्त्र ब्रिगेड का, जिसमें अभियुक्त व्यक्ति सेवा कर रहा है, समादेशन करने वाले आफिसर के या ऐसे अन्य आफिसर के, जो विहित किया जाए, विवेकाधीन होगा और यदि वह आफिसर विनिश्चित करता है कि वे सेना - न्यायालय के समक्ष संस्थित की जाएं तो यह निदेश देना कि अभियुक्त व्यक्ति को सैनिक अभिरक्षा में निरुद्ध किया जाए उसके विवेकाधीन होगा।
