Section 107 The Army Act, 1950  :Provost- marshals.

(1) Provost- marshals may be appointed by 1[ the Chief of the Army Staff] or by any prescribed officer.

(2) The duties of a provost- marshal are to take charge of persons confined for any offence, to preserve good order and discipline, and to prevent breaches of the same by persons serving in, or attached to, the regular Army.

(3) A provost- marshal may act any time arrest and detain for trial any person subject to this Act who commits, or is charged with, an offence, and may also carry into effect any punishment to be inflicted in pursuance of the sentence awarded by a court- martial, or by an officer exercising authority under section 80 but shall not inflict any punishment on his own authority:

1. Subs. by Act 19 of 1955, s. 2 and Sch., for" the Commander- in- Chief". Provided that no officer shall be so arrested or detained otherwise than on the order of another officer.

(4) For the purposes of sub- sections (2) and (3), a provost- marshal shall be deemed to include a provost- marshal appointed under any law for the time being in force relating to the Government of the Navy or Air Force, and any person legally exercising authority under him or on his behalf. CHAP

सेना अधिनियम, 1950 की धारा 107 का विवरण :  - प्रोवो मार्शल - (1) प्रोवो मार्शल थल सेनाध्यक्ष द्वारा या किसी विहित आफिसर द्वारा नियुक्त किए जा सकेंगे।

(2) प्रोवो मार्शल के कर्तव्य हैं किसी अपराध के लिए परिरुद्ध व्यक्तियों को अपने भारसाधन में लेना और उन व्यक्तियों में जो नियमित सेना में सेवा करते हैं या उससे संलग्न हैं, सुव्यवस्था और अनुशासन बनाए रखना तथा उनका उनके द्वारा भंग किया जाना निवारित करना।

(3) कोई प्रोवो मार्शल इस अधिनियम के अध्यधीन के किसी ऐसे व्यक्ति को, जो कोई अपराध करता है या जिस पर किसी अपराध का आरोप है, विचारण के लिए किसी भी समय गिरफ्तार और निरुद्ध कर सकेगा तथा किसी सेना - न्यायालय द्वारा या किसी ऐसे आफिसर द्वारा जो धारा 80 के अधीन प्राधिकार का प्रयोग कर रहा है, अधिनिर्णीत दंडादेश के अनुसरण में दिए जाने वाले दंड को कार्यान्वित भी कर सकेगा किन्तु अपने स्वयं के प्राधिकार से वह कोई दंड नहीं देगा:

परन्तु कोई आफिसर किसी अन्य आफिसर के आदेश पर गिरफ्तार या निरुद्ध किए जाने से अन्यथा ऐसे गिरफ्तार या निरुद्ध नहीं किया जाएगा।

(4) उपधारा (2) और (3) के प्रयोजनों के लिए यह समझा जाएगा कि प्रोवो मार्शल के अंतर्गत तत्समय नौसेना या वायुसेना शासन से संबंधित विधि के अधीन नियुक्त प्रोवो मार्शल और ऐसा व्यक्ति जो उससे या उसकी ओर से प्राधिकार का वैध रूप से प्रयोग कर रहा है, आता है।
