Section 91 The Army Act, 1950  :Deductions from pay and allowances of persons other than officers. Subject to the provisions of section 94 the following penal deductions may be made from the pay and allowances of a person subject to this, Act other than an officer, that is to say,-

(a) all pay and allowances for every day of absence either on desertion or without leave, or as a prisoner of war, and for every day of transportation or imprisonment awarded by a criminal court, a court- martial or an officer exercising authority under section 80 3[

(b) all pay and allowances for every day while he is in custody on a charge for an offence of which he is afterwards convicted by a criminal court or a court- martial, or on a charge of absence without leave for which he is afterwards awarded imprisonment 3[ by an officer exercising authority under section 80;

(c) all pay and allowances for every day on which he is in hospital on account of sickness certified by the medical officer attending on him to have been caused by an offence under this Act committed by him;

(d) for every day on which he is in hospital on account of sickness certified by the medical officer attending on him

(e) all pay and allowances ordered by a court- martial or by an officer exercising authority under any of the sections 80, 83, 84 and 85, to be forfeited or stopped;

(f) all pay and allowances for every day between his being recovered from the enemy and his dismissal from the service in consequence of his conduct when being taken prisoner by, or while in the hands of, the enemy;

(g) any sum required to make good such compensation for any expenses, loss, damage or destruction caused by him to the Central Government or to any building or property as may be awarded by his commanding officer;

(h) any sum required to, pay a fine awarded by a criminal court, a court- martial exercising jurisdiction under section 69, or an officer exercising authority under any of the sections 80 and 89;

(i) any sum required by order of the Central Government or any prescribed officer to be paid for the maintenance of his wife or his legitimate or illegitimate child or towards the cost of any relief given by the said Government to the said wife or child.

सेना अधिनियम, 1950 की धारा 91 का विवरण :  - आफ़िसरों से भिन्न व्यक्तियों के वेतन और भत्तों में से कटौतियां - धारा 94 के उपबन्धों के अध्यधीन यह है कि आफिसर से भिन्न इस अधिनियम के अध्यधीन किसी भी व्यक्ति के वेतन और भत्तों में से निम्नलिखित शास्तिक कटौतियां की जा सकेंगी, अर्थात् :

(क) अभित्यन पर या छुट्टी बिना या युद्ध कैदी होने के कारण अनुपस्थिति के हर दिन के लिए और किसी भी दंड न्यायालय, सेना - न्यायालय या किसी ऐसे आफिसर द्वारा जो धारा 80 के अधीन प्राधिकार का प्रयोग कर रहा है अधिनिर्णीत निर्वासन या कारावास के हर दिन के लिए सब वेतन और भत्ते,

(ख) हर ऐसे दिन के सब वेतन और भत्ते जब कि वह किसी ऐसे अपराध के आरोप पर जिसके लिए वह तत्पश्चात् किसी दंड - न्यायालय द्वारा या सेना - न्यायालय द्वारा सिद्धदोष ठहराया जाता है या छुट्टी बिना ऐसी अनुपस्थिति के आरोप पर जिसके लिए तत्पश्चात् उसे किसी ऐसे आफिसर द्वारा जो धारा 80 के अधीन प्राधिकार का प्रयोग कर रहा है कारावास अधिनिीत किया जाता है, अभिरक्षा में रहा है,

(ग) हर ऐसे दिन के सब वेतन और भत्ते जब वह ऐसी रुग्णता के कारण अस्पताल में रहा है जिसकी बाबत उसकी परिचर्या करने वाले चिकित्सा आफिसर द्वारा यह प्रमाण दिया गया है कि वह उसके द्वारा किए गए इस अधिनियम के अधीन के किसी अपराध से कारित हुई है,

(घ) हर ऐसे दिन के लिए, जब वह ऐसी रुग्णता के कारण अस्पताल में रहा है जिसकी बाबत उसकी परिचर्या करने वाले चिकित्सा आफिसर द्वारा यह प्रमाणपत्र दिया गया है कि वह उसके अपने अवचार या प्रज्ञाहीनता से कारित हुई है, उतनी राशि जितनी केन्द्रीय सरकार के या ऐसे आफिसर के, जो उस सरकार द्वारा विनिर्दिष्ट किया जाए, आदेश द्वारा विनिर्दिष्ट की जाए,

(ङ) वे सब वेतन और सब भत्ते जिनके समपहरण या रोक दिए जाने का आदेश किसी सेवा - न्यायालय या किसी ऐसे आफिसर द्वारा जो धाराओं 80, 83, 84 और 85 में से किसी के अधीन प्राधिकार का प्रयोग कर रहा है, दिया गया है,

(च) शत्रु से उसका उद्धार किए जाने के और सेवा से उसकी ऐसी पदच्युति के, जो शत्रु द्वारा उसके कैदी बनाए जाने के समय के या शत्रु के हाथ में उसके रहने के दौरान के उसके आचरण के परिणामस्वरूप हुई है बीच के हर दिन के सब वेतन और भत्ते,

(छ) केन्द्रीय सरकार को या किसी निर्माण या सम्पत्ति को उसके द्वारा कारित व्ययों, हानि, नुकसान या नाश के लिए ऐसे प्रतिकर की जो उसके कमान आफिसर द्वारा अधिनिर्णीत की जाए, प्रतिपूर्ति के लिए अपेक्षित कोई राशि,

(ज) किसी दण्ड - न्यायालय द्वारा या किसी ऐसे सेना - न्यायालय द्वारा या जो धारा 69 के अधीन अधिकारिता का प्रयोग कर रहा है सेना - न्यायालय द्वारा या किसी ऐसे आफिसर द्वारा जो धारा 80 और 89 में से किसी के अधीन प्राधिकार का प्रयोग कर रहा है अधिनिर्णीत जुर्माने के संदाय के लिए अपेक्षित कोई राशि,

(झ) केन्द्रीय सरकार के या किसी विहित आफिसर के आदेश द्वारा उसकी पत्नी या उसकी धर्मज या अधर्मज सन्तान के भरण - पोषण के लिए दिए जाने के लिए या उक्त सरकार द्वारा उक्त पत्नी या सन्तान को दी गई सहायता के खर्चे के निमित्त दिए जाने के लिए अपेक्षित कोई राशि।
