Section 75 Contract Act 1872 :Party rightfully rescinding contract, entitled to compensation - A person who rightfully rescinds a contract is entitled to compensation for any damage which he has sustained through the non-fulfilment of the contract.

Illustration

A, a singer, contracts with B, the manager of a theatre, to sing at his theatre for two nights in every week during the next two months, and B engages to pay her 100 rupees for each night's performance. On the sixth night, A wilfully absents herself from the theatre, and B, in consequence, rescinds the contracts. B is entitled to claim compensation for the damage which he has sustained through the non-fulfilment of the contract.

भारतीय संविदा अधिनियम, 1872 की धारा 75 का विवरण :  -  संविदा को अधिकारपूर्वक विखंडित करने वाला पक्षकार प्रतिकर का हकदार है -- वह व्यक्ति, जो किसी संविदा को अधिकारपूर्वक विखण्डित करता है, ऐसे नुकसान के लिए प्रतिकर पाने का हकदार है जो उसने उस संविदा का पालन न किए जाने से उठाया है।

दृष्टान्त

एक गायिका 'क' एक नाट्यगृह के प्रबन्धक ‘ख’ से अगले दो मास में प्रति सप्ताह में दो रात उसके नाट्यगृह में गाने की संविदा करती है और ‘ख’ उसे हर रात के गाने के लिए एक सौ रुपये देने के लिए वचनबद्ध होता है। छठी रात को 'क' उस नाट्यगृह से जानबूझकर अनुपस्थित रहती है और परिणामस्वरूप ‘ख’ उस संविदा को विखण्डित कर देता है। ‘ख’ उस नुकसान के लिए प्रतिकर का दावा करने का हकदार है जो उसने उस संविदा के पूरा न किए जाने पर उठाया है।
