Section 65 Contract Act 1872 :Obligation of person who has received advantage under void agreement, or contract that becomes void – When an agreement is discovered to be void, or when a contract becomes void, any person who has received any advantage under such agreement or contract is bound to restore it, or to make compensation for it to the person from whom he received it.

Illustrations

(a) A pays B 1,000 rupees, in consideration of B's promising to marry C, A's daughter. C is dead at the time of the promise. The agreement is void, but B must repay A the 1,000 rupees.

(b) A contract with B to deliver to him 250 maunds of rice before the first of May. A delivers 130 maunds only before that day, and none after. B retains the 130 maunds after the first of May. He is bound to pay A for them.

(c) A, a singer, contracts with B, the manager of a theatre, to sing at his theatre for two nights in every week during the next two months, and B engages to pay her a hundred rupees for each night's performance. On the sixth night, A wilfully absents herself from the theatre, and B, in consequence, rescinds the contract. B must pay A for the five nights on which she had sung.

(d) A contract to sing for B at a concert for 1,000 rupees, which are paid in advance. A is too ill to sing. A is not bound to make compensation to B for the loss of the profits which B would have made if A had been able to sing, but must refund to B the 1,000 rupees paid in advance.

भारतीय संविदा अधिनियम, 1872 की धारा 65 का विवरण :  -  उस व्यक्ति की बाध्यता, जिसने शून्य करार के अधीन या उस संविदा के अधीन जो शुन्य हो गई हो, फायदा प्राप्त किया हो -- जबकि किसी करार के शून्य होने का पता चले या कोई संविदा शून्य हो जाए, तब वह व्यक्ति जिसने ऐसे करार या संविदा के अधीन कोई फायदा प्राप्त किया हो वह फायदा उस व्यक्ति को, जिससे उसने उसे प्राप्त किया था, प्रत्यावर्तित करने या उसके लिए प्रतिकर देने को आबद्ध होगा।

दृष्टान्त

(क) 'ख' को यह वचन देने के प्रतिफलस्वरूप कि वह 'क' की पुत्री 'ग' से विवाह कर लेगा ‘ख’ को ‘क’ 1,000 रुपये देता है। वचन के समय 'ग' मर चुकी है। करार शून्य है, किन्तु 'ख' को वे 1,000 रुपये 'क' को प्रतिसंदत्त करने होंगे।

(ख) 'ख' से 'क' उसे एक मई के पूर्व 250 मन चावल परिदत्त करने की संविदा करता है। ‘क’ उस दिन के पूर्व केवल 130 मन परिदत्त करता है और तत्पश्चात् कुछ नहीं। ‘ख’ उस 130 मन को एक मई के पश्चात् रखे रखता है।

वह 'क' को उसके लिए संदाय करने को आबद्ध है।

(ग) एक गायिका 'क', एक नाट्यगृह प्रबंधक ‘ख’, से अगले दो मास में प्रति सप्ताह में दो रात उसके नाट्यगृह में गाने की संविदा करती है और ‘ख’ उसे हर रात के गाने के लिए एक सौ रुपये देने के लिए वचनबद्ध होता है। छठी रात को ‘क’ उस नाट्यगृह से जानबूझकर अनुपस्थित रहती है और परिणामस्वरूप 'ख' उस संविदा को विखंडित कर देता है। ‘ख’ को उन पाँचों रातों के लिए, जिनमें ‘क’ ने गाया था, उसे संदाय करना होगा।

(घ) 'क' एक संगीत समारोह में 1,000 रुपये पर, जो अग्रिम दिए जाते हैं, ‘ख’ के लिए गाने की संविदा करती है। ‘क’ इतनी रुग्ण है कि गा नहीं सकती। 'क' उन लाभों की हानि के लिए प्रतिकर देने को आबद्ध नहीं है, जो 'ख'

को होते, यदि ‘क’ गा सकती, किन्तु उसे अग्रिम दिए गए 1,000 रुपये ‘ख’ को लौटाने होंगे।
