Section 57 Contract Act 1872 :Reciprocal promise to do things legal, and also other things illegal - Where persons reciprocally promise, firstly to do certain things which are legal, and secondly, under specified circumstances, to do certain other things which are illegal, the first set of promises is a contract, but the second is a void agreement.

Illustration

A and B agree that A shall sell B a house for 10,000 rupees, but that, if B uses it as a gambling house, he shall pay A 50,000 rupees for it. 

The first set of reciprocal promises, namely, to sell the house and to pay 10,000 rupees for it, is a contract. 

The second set is for an unlawful object, namely, that B may use the house as a gambling house, and is a void agreement.

भारतीय संविदा अधिनियम, 1872 की धारा 57 का विवरण :  -  वैध बातों, और ऐसी अन्य बातों को भी, जो अवैध हों, करने का व्यतिकारी वचन -- जहाँ कि कोई व्यक्ति, प्रथमत: कुछ ऐसी बातें करने का, जो वैध हों, और द्वितीयतः विनिर्देशित परिस्थितियों में, कुछ अन्य बातें करने का, जो अवैध हों, व्यतिकारी वचन देते हैं, वहाँ वचनों का प्रथम संवर्ग, संविदा है किन्तु द्वितीय संवर्ग शून्य करार है।

दृष्टान्त

'क' और 'ख' करार करते हैं कि 'ख' को एक गृह 'क' 10,000 रुपये में बेचेगा, किन्तु यदि 'ख' उसे एक द्यूत​गृह के रूप में उपयोग में लाए तो वह 'क' को उसके लिए 50,000 रुपये देगा। 

व्यतिकारी बचनों का, अर्थात् गृह को बेचने का और उसके लिए 10,000 रुपये देने का प्रथम वचन-संवर्ग एक संविदा है।

द्वितीय संवर्ग एक विधि-विरुद्ध उद्देश्य के लिए है, अर्थात् इस उद्देश्य के लिए है कि 'ख' उस गृह को द्यूत​गृह के रूप में उपयोग में लाए, और वह शून्य करार है।
