Section 57 The Army Act, 1950  :Falsifying official documents and false declaration. Any person subject to this Act who

commits any of the following offences, that is to say,-

(a) in any report, return, list, certificate, book or other document made or signed by him, or of the

contents of which it is his duty to ascertain the accuracy, knowingly makes,

or is privy to the making of any false or fraudulent statement; or

(b) in any document of the description mentioned in clause (a) knowingly makes, or is privy to the

making of, any omission, with intent to defraud; or

(c) knowingly and with intent to injure any person, or knowingly and with intent to defraud, suppresses,

defaces, alters or makes away with any document which it is his duty to preserve or produce; or

(d) where it is his official duty to make a declaration respecting any matter, knowingly makes a false

declaration; or

(e) obtains for himself, or for any other person, any pension, allowance or other advantage or privilege

by a state- ment which is false, and which he either knows or believes to be false or does not believe

to be true, or by making or using a false entry in any book or record or by making any document

containing a false statement, or by omitting to make a true entry or document containing a true

statement; shall, on conviction by court- martial, be liable to suffer imprison- ment for a term which

may extend to fourteen years or such less punishment as is in this Act mentioned.

सेना अधिनियम, 1950 की धारा 57 का विवरण :  -  शासकीय दस्तावेजों का मिथ्याकरण तथा मिथ्या घोषणा - इस अधिनियम के अध्यधीन का कोई व्यक्ति जो निम्नलिखित अपराधों में से कोई अपराध करेगा, अर्थात् :

(क) किसी ऐसी रिपोर्ट, विवरणी, सूची, प्रमाणपत्र, पुस्तक या अन्य दस्तावेज में जो उसके द्वारा बनाई या हस्ताक्षरित की गई है या जिसकी विषय-वस्तु की यथार्थता का अभिनिश्चय करना उसका कर्तव्य है, कोई मिथ्या या कपटपूर्ण कथन जानते हुए करेगा या किए जाने में संसर्गी होगा, अथवा

(ख) कपट-वंचन करने के आशय से किसी ऐसी दस्तावेज में जो खंड (क) में वर्णित वर्णन की है कोई लोप जानते हुए करेगा या लोप के किए जाने में संसर्गी होगा, अथवा

(ग) जानते हुए और किसी व्यक्ति को क्षति करने के आशय से या जानते हुए और कपट-वंचन करने के आशय से किसी ऐसी दस्तावेज को, जिससे परिरक्षित रखना या पेश करना उसका कर्तव्य है दबा लेगा, विरूपित करेगा, परिवर्तित करेगा या गायब कर देगा, अथवा

(घ) जहां कि किसी बात के बारे में घोषणा करना उसका पदीय कर्तव्य है वहां जानते हुए मिथ्या घोषणा करेगा, अथवा

(ङ) अपने लिए या किसी अन्य व्यक्ति के लिए कोई पेंशन, भत्ता या अन्य फायदा या विशेषाधिकार ऐसे कथन से, जो मिथ्या है, और जिसके मिथ्या होने का उसे या तो ज्ञान है या विश्वास है या जिसके सत्य होने का उसे विश्वास नहीं है, अथवा किसी पुस्तक या अभिलेख में कोई मिथ्या प्रविष्टि करके या उसमें की मिथ्या प्रविष्टि का उपयोग करके, अथवा मिथ्या कथन अन्तर्विष्ट करने वाली कोई दस्तावेज बनाकर, अथवा कोई सही प्रविष्टि करने का या सत्य कथन अन्तर्विष्ट रखने वाली दस्तावेज बनाने का लोप करके, अभिप्राप्त करेगा,

सेना-न्यायालय द्वारा दोषसिद्धि पर कारावास, जिसकी अवधि चौदह वर्ष तक की हो सकेगी या ऐसा लघुतर दंड, जो इस अधिनियम में वर्णित है, भोगने के दायित्व के अधीन होगा।
