Section 53 Contract Act 1872 :Liability of party preventing event on which the contract is to take effect - When a contract contains reciprocal promises, and one party to the contract prevents the other from performing his promise, the contract becomes voidable at the option of the party so prevented: and he is entitled to compensation from the other party for any loss which he may sustain in consequence of the non-performance of the contract.

Illustration

A and B contract that B shall execute certain work for A for a thousand rupees. B is ready and willing to execute the work accordingly, but A prevents him from doing so. The contract is voidable at the option of B; and, if he elects to rescind it, he is entitled to recover from A compensation for any loss which he has incurred by its non-performance.

भारतीय संविदा अधिनियम, 1872 की धारा 53 का विवरण :  -  जिस घटना के घटित होने पर संविदा प्रभावशील होनी है उसका निवारण करने वाले पक्षकार का दायित्व -- जबकि किसी संविदा में व्यतिकारी वचन अन्तर्विष्ट हो और संविदा का एक पक्षकार दूसरे को उसके वचन का पालन करने से निवारित करे तब वह संविदा इस प्रकार निवारित किए गए पक्षकार के विकल्प पर शून्यकरणीय हो जाती है, और वह किसी भी हानि के लिए, जो संविदा के अपालन के परिणामस्वरूप उसे उठानी पड़े; दूसरे पक्षकार से प्रतिकर पाने का हकदार है।

दृष्टान्त

(क्) 'क' और 'ख' संविदा करते हैं कि 'ख' एक हजार रुपये के बदले ‘क’ के लिए अमुक काम निष्पादित करेगा। ‘ख' उस काम को तदनुसार निष्पादित करने के लिए तैयार और रजामन्द है, किन्तु 'क' उसे वैसा करने से निवारित करता है। संविदा 'ख' के विकल्प पर शून्यकरणीय है, और यदि वह उसे विखंडित करने का निर्वाचन करे तो वह किसी भी हानि के लिए, जो उसने उसके अपालन से उठाई हो, 'क' से प्रतिकर वसूल करने का हकदार है।
