Section 52 Contract Act 1872 :Order of performance of reciprocal promises – Where the order in which reciprocal promises are to be performed is expressly fixed by the contract, they shall be performed in that order; and where the order is not expressly fixed by the contract, they shall be performed in that order which the nature of the transaction requires.

Illustrations

(a) A and B contract that A shall build a house for B at a fixed price. As promise to build the house must be performed before B's promise to pay for it.

(b) A and B contract that A shall make over his stock-in-trade to B at a fixed price, and B promise to give security for the payment of the money. A's promise need not be performed until the security is given, for the nature of transaction requires that A should have security before he delivers up his stock.

भारतीय संविदा अधिनियम, 1872 की धारा 52 का विवरण :  -  व्यतिकारी वचनों के पालन का क्रम -- जहाँ कि वह क्रम, जिससे व्यतिकारी वच का पालन किया जाना है, संविदा द्वारा अभिव्यक्तत: नियत हो वहाँ उनका पालन उसी क्रम से किया जाएगा और जहाँ कि वह क्रम संविदा द्वारा अभिव्यक्ततः नियत न हो वहाँ उनका पालन उस क्रम से किया जाएगा जो उस संव्यवहार की प्रकृति द्वारा अपेक्षित हो।

दृष्टान्तं

(क) 'क' और 'ख' संविदा करते हैं कि 'क' नियत कीमत पर 'ख' के लिए एक गृह बनाएगा। 'क' को गृह बनाने के वचन का पालन 'ख' द्वारा उसके लिए संदाय के वचन के पालन से पहले करना होगा।

(ख) 'क' और 'ख' संविदा करते हैं कि 'क' अपना व्यापार-स्टॉक एक नियत कीमत पर 'क' को दे देगा; और 'ख' 13 धन के संदाय के लिए प्रतिभूति देने का वचन देता है। ‘क’ के वचन का पालन किया जाना तब तक आवश्यक नहीं है जब तक प्रतिभूति न दे दी जाए, क्योंकि इस संव्यवहार की प्रकृति यह अपेक्षा करती है कि अपने व्यापार| | स्टॉक का परिदान करने से पूर्व 'क' को प्रतिभूति मिलनी चाहिये।
