Section 47 Contract Act 1872 :Time and place for performance of promise, where time is specified and no application to be made — When a promise is to be performed on a certain day, and the promisor has undertaken to perform it without application by the promisee, the promisor may perform it at any time during the usual hours of business on such day and at the place at which the promise ought to be performed.

Illustration

A promises to deliver goods at B's warehouse on the first January. On the day A brings the goods to B's warehouse, but after the usual hour closing it, and they are not received. A has not performed his promise.

भारतीय संविदा अधिनियम, 1872 की धारा 47 का विवरण :  -  वचन पालन के लिए समय और स्थान जहाँ कि पालन के लिए समय विनिर्दिष्ट हो और आवेदन न किया जाना हो -- जबकि किसी वचन का पालन अमुक दिन किया जाना हो और वचनदाता ने वचनग्रहीता द्वारा आवेदन किए जाने के बिना उसका पालन करने का वचन दिया हो तब कारबार के प्रायिक घण्टों के दौरान किसी भी समय ऐसे दिन और स्थान पर, जिस पर उस वचन का पालन किया जाना चाहिये, वचनदाता उसका पालन कर सकेगा।

 दृष्टान्त

'क' वंचन देता है कि वह पहली जनवरी को 'ख' के भाण्डागार में माल परिदत्त करेगा। उस दिन ‘क’ माल को 'ख' के भाण्डागार में लाता है, किन्तु उसके बन्द होने के प्रायिक घण्टे के पश्चात् और माल नहीं लिया जाता। 'के' ने अपने वचन का पालन नहीं किया।
