Section 40 Contract Act 1872 :Person by whom promise is to be performed - If it appears from the nature of the case that it was the intention of the parties to any contract that any promise contained in it should be performed by the promisor himself, such promise must be performed by the promisor. In other cases, the promisor or his representative may employ a competent person to perform it.

Illustrations

(a) A promises to pay B a sum of money., A may perform this promise, either by personally paying the money to B or by causing it to be paid to B by another; and, if A dies before the time appointed for payment, his representatives must perform the promise, or employ some proper person to do so.

(b) A promises to paint a picture for B. A must perform this promise personally.

भारतीय संविदा अधिनियम, 1872 की धारा 40 का विवरण :  -  वह व्यक्ति जिसे वचन का पालन करना है -- यदि मामले की प्रकृति से यह प्रतीत होता है कि किसी संविदा के पक्षकारों का यह आशय था कि उसमें अन्तर्विष्ट किसी वचन का पालन स्वयं वचनदाता द्वारा किया जाना चाहिए तो ऐसे वचन का पालन वचनदाता को ही करना होगा। अन्य दशाओं में वचनदाता या उसके प्रतिनिधि उसका पालन करने के लिए किसी सक्षम व्यक्ति को नियोजित कर सकेंगे।

दृष्टान्त

(क) ‘ख’ को एक धनराशि देने का वचन ‘क’ देता है। 'क' इस वचन का पालन ‘ख’ को वह धन स्वयं देकर या उसे किसी और के द्वारा दिलवाकर कर सकेगा। और यदि संदाय के लिए नियत समय से पूर्व 'क' मर जाए तो उसके प्रतिनिधियों को वचन का पालन करना होगा या उसके पालन के लिए किसी उचित व्यक्ति को नियोजित करना होगा।

(ख) 'ख' के लिए एक रंगचित्र बनाने का वचन ‘क’ देता है। ‘क’ को इस वचन का पालन स्वयं करना होगा।
