Section 35 Contract Act 1872 :When contracts become void, which are contingent on happening of specified event within fixed time - Contingent contracts to do or not to do anything, if a specified uncertain event happens within a fixed time, become void if, at the expiration of the time fixed, such event has not happened, or if, before the time fixed, such event becomes impossible.

When contracts may be enforced, which are contingent on specified event not happening within fixed time-Contingent contracts to do or not to do anything, if a specified uncertain event does not happen within a fixed time, may be enforced by law when the time fixed has expired, and such event has not happened, or before the time fixed has expired, if it becomes certain that such event will not happen.

Illustrations

(a) A promises to pay B a sum of money if a certain ship returns within a year. The contract may be enforced if the ship returns within the year; and becomes void if the ship is burnt within the year.

(b) A promises to pay B a sum of money if a certain ship does not return within a year. The contract may be enforced if the ship does not return within the year,

भारतीय संविदा अधिनियम, 1872 की धारा 35 का विवरण :  -  संविदाएँ जो नियत समय के भीतर विनिर्दिष्ट घटना के घटित होने पर समाश्रित हों, कब शुन्य हो जाती है -- समाश्रित संविदाएँ, जो किसी विनिर्दिष्ट अनिश्चित घटना के किसी नियत समय के भीतर घटित होने पर किसी बात को करने या न करने के लिए हों, शून्य हो जाती हैं, यदि उस नियत समय के अवसान पर ऐसी घटना न घटित हुई हो या यदि उस नियत समय से पूर्व ऐसी घटना असम्भव हो जाए।

विनिर्दिष्ट घटना के नियत समय के भीतर घटित न होने पर समाश्रित संविदाओं का प्रवर्तन कब कराया जा सकेगा -- समाश्रित संविदाएँ, जो किसी विनिर्दिष्ट अनिश्चित घटना के किसी नियत समय के भीतर घटित न होने पर किसी बात को करने या न करने के लिए हों, विधि द्वारा तब प्रवर्तित कराई जा सकेंगी जब उस नियत समय का अवसान हो गया हो और ऐसी घटना घटित न हुई हो या उस नियत समय के अवसान से पूर्व यह निश्चित हो जाए कि ऐसी घटना घटित नहीं होगी।

दृष्टान्त

 (क) 'क' वचन देता है कि यदि अमुक पोत एक वर्ष के भीतर वापस आ जाए तो वह 'ख' को एक धनराशि देगा। यदि पोत उस वर्ष के भीतर वापस आ जाए तो संविदा का प्रवर्तन कराया जा सकेगा और यदि पोत उस वर्ष के भीतर जल जाए तो संविदा शून्य हो जाएगी।

(ख) 'क' वचन देता है कि अमुक पोत एक वर्ष के भीतर न लौटे तो वह 'ख' को एक धनराशि देगा। यदि पोत उस वर्ष के भीतर न लौटे या उस वर्ष के भीतर जल जाए तो संविदा का प्रवर्तन कराया जा सकेगा।
