Section 231 Contract Act 1872 : Right of parties to a contract made by agent not disclosed - If an agent makes a contract with a person who neither knows, nor has reason to suspect, that he is an agent, his principal may require the performance of the contract; but the other contracting party has, as against the principal, the same rights as he would have had as against the agent if the agent had been principal. If the principal

discloses himself before the contract is completed, the other contracting party may refuse to fulfil the contract, if he can show that, if he had known who was the principal in the contract, or if he had known that the agent was not a principal, he would not have entered into the contract.

भारतीय संविदा अधिनियम, 1872 की धारा 231 का विवरण :  -  अप्रकटित अभिकर्ता द्वारा की गई संविदा के पक्षकारों के अधिकार -- यदि कोई अभिकर्ता ऐसे व्यक्ति से संविदा करे, जो न तो वह जानता हो और न यह सन्देह करने का कारण रखता हो कि वह अभिकर्ता है, तो अभिकर्ता का मालिक यह अपेक्षा कर सकेगा कि संविदा का पालन किया जाए, किन्तु संविदा करने वाला दूसरा पक्षकार उस मालिक के विरुद्ध वे ही अधिकार रखता है जो वह उस अभिकर्ता के विरुद्ध रखता यदि वह अभिकर्ता मालिक होता।

 यदि मालिक संविदा पूर्ण होने के पूर्व अपने आपको प्रकट कर दे तो संविदा करने वाला दूसरा पक्षकार उस संविदा का पालन करने से इन्कार कर सकेगा यदि वह यह दर्शित कर सके कि यदि उसे यह ज्ञात होता कि संविदा में मालिक कौन है या यदि उसे यह ज्ञात होता कि वह अभिकर्ता मालिक नहीं है तो उसने वह संविदा न की होता।
