Section 230 Contract Act 1872 :Agent cannot personally enforce, nor be bound by, contracts on behalf of principal — In the absence of any contact to that effect an agent cannot personally enforce contracts entered into by him on behalf of his principal, nor is he personally bound by them.

Presumption of contract to contrary - Such a contract shall be presumed to exist in the following cases -

(1) where the contract is made by an agent for the sale or purchase of goods for a merchant resident abroad;

(2) where the agent does not disclose the name of his principal;

(3) where the principal, though disclosed, cannot be sued.

भारतीय संविदा अधिनियम, 1872 की धारा 230 का विवरण :  -  मालिक की ओर से की गई संविदाओं को अभिकर्ता वैयक्तिक रूप से न तो प्रवर्तित करा सकता है और न उनसे आबद्ध ही होता है -- किसी तत्प्रभावी संविदा के अभाव में कोई भी अभिकर्ता अपने मालिक की ओर से अपने द्वारा की गई संविदाओं का प्रवर्तन वैयक्तिक रूप से नहीं करा सकता और न वैयक्तिक रूप से उनसे आबद्ध होता है।

तत्प्रतिकूल संविदा की उपधारणा -- ऐसी संविदा के अस्तित्व की उपधारणा निम्नलिखित दशाओं में की जाएगी --

(1) जहाँ कि संविदा किसी अभिकर्ता द्वारा किसी विदेश निवासी वणिक की ओर से माल के विक्रय या क्रय के लिए की गई हो।

(2) जहाँ कि अभिकर्ता अपने मालिक का नाम प्रकट नहीं करता।

(3) जहाँ कि मालिक पर, यद्यपि उसका नाम प्रकट कर दिया गया हो, वाद नहीं लाया जा सकता।
