Section 228 Contract Act 1872 :Principal not bound when excess of agent's authority is not separable - Where an agent does more than he is authorized to do, and what he does beyond the scope of his authority cannot be separated from what is within it, the principal is not bound to recognize the transaction.

llustration

A, authorizes B to buy 500 sheep for him. B buys 500 sheep and 200 lambs for one sum of 6,000 rupees. A may repudiate the whole transaction.

भारतीय संविदा अधिनियम, 1872 की धारा 228 का विवरण :  -  मालिक आबद्ध न होगा जहाँ कि अभिकर्ता के प्राधिकार से परे किया गया कार्य पृथक नहीं किया जा सकता -- जहाँ कि अभिकर्ता उससे अधिक करता है जितना करने के लिए वह प्राधिकृत है और अपने प्राधिकार के विस्तार से परे जो कुछ वह करता है वह उससे पृथक् नहीं किया जा सकता जो उसके प्राधिकार के भीतर हैं, वहाँ मालिक उस संव्यवहार को मान्यता देने के लिए आबद्ध नहीं है।

दृष्टान्त

'क', अपने लिए 500 भेड़े खरीदने के लिए 'ख' को प्राधिकृत करता है। ‘ख’ 6,000 रुपये की राशि में 500 भेड़े और 200 मेमने खरीद लेता है। 'क' सम्पूर्ण संव्यवहार का निराकरण कर सकेगा।
