Section 216 Contract Act 1872 :Principal's right to benefit gained by agent dealing on his own account in business of agency - If an agent, without the knowledge of his principal, deals in the business of the agency on his own account instead of on account of his principal, the principal is entitled to claim from the agent any benefit which may have resulted to him from the transaction.

Illustration

A directs B, his agent, to buy a certain house for him. B tells A it cannot be bought, and buys the house for himself. A may, on discovering that B has bought the house, compel him to sell it to A at the price he gave for it.

भारतीय संविदा अधिनियम, 1872 की धारा 216 का विवरण :  -  अभिकरण के कारबार में अभिकर्ता को अपने लेखा व्यवहार को करने से प्राप्त फायदे पर मालिक का अधिकार -- यदि कोई अभिकर्ता अपने मालिक के ज्ञान के बिना अभिकरण के कारबार में अपने मालिक के लेखे व्यवहार करने के बजाय अपने ही लेख्ने व्यवहार करता है तो मालिक अभिकर्ता से उस फायदे का दावा करने का हकदार है। जो अभिकर्ता को उस संव्यवहार से हुआ हो।

 दृष्टान्त

'क' अपने लिए अमुक गृह खरीदने का निदेश अपने अभिकर्ता 'ख' को देता है। 'क' से 'ख' कहता है कि वह खरीदा नहीं जा सकता और उसे अपने लिए खरीद लेता है। यह जाँचने पर कि 'ख' ने गृह खरीद लिया है 'क' उसे वह घर अपने को उस कीमत पर, जो 'ख' ने दी हो, बेचने के लिए विवश कर सकेगा।
