Section 178 Contract Act 1872 :Pledge by mercantile agent - Where a mercantile agent is, with the consent of the owner, in possession of goods or the document of title to goods, any pledge made by him, when acting in the ordinary course of business of a mercantile agent, shall be as valid as if he were expressly authorised by the owner of the goods to make the same; provided that the pawnee acts in good faith and has not at the time of the pledge notice that the pawnor has not authority to pledge

Explanation.— In this section, the expressions “mercantile agent” and “documents of title” shall have the meanings assigned to them in the Indian Sale of Goods Act, 1930 (3 of 1930).

भारतीय संविदा अधिनियम, 1872 की धारा 178 का विवरण :  -  वाणिज्यिक अभिकर्ता द्वारा गिरवी -- जहाँ कि कोई वाणिज्यिक अभिकर्ता स्वामी की सम्मति से माल पर या माल के हक के दस्तावेजों पर कब्जा रखता है वहाँ वाणिज्यिक अभिकर्ता के कारबार के मामली अनुक्रम में कार्य करते हुए उसके द्वारा की गई गिरवी उतनी ही विधिमान्य होगी मानो वह माल के स्वामी द्वारा, उसे करने के लिए अभिव्यक्त रूप से प्राधिकृत हो, परन्तु यह तब जबकि पणयमदार सद्भावपूर्वक कार्य करे और गिरवी के समय उसे वह सूचना न हो कि पणयमकार गिरवी करने का प्राधिकार नहीं रखता।

स्पष्टीकरण -- इस धारा में वाणिज्यिक अभिकर्ता” और “हक की दस्तावेजों' पदों के वे ही अर्थ होंगे, जो उन्हें भारतीय माल विक्रय अधिनियम, 1930 (1930 का 3) में समनुदिष्ट हैं।
