Section 157 Contract Act 1872 :Effect of mixture, without bailor's consent, when the goods cannot be separated — If the bailee, without the consent of the bailor, mixes the goods of the bailor with his own goods in such a manner that it is impossible to separate the goods bailed from the other goods and deliver them back, the bailor is entitled to be compensated by the bailee for the loss of the goods.

Illustration

A bails a barrel of Cape flour worth Rs. 45 to B. B, without As consent, mixes the flour with country flour of his own, worth only Rs. 25 a barrel. B must compensate A for the loss of his flour.

भारतीय संविदा अधिनियम, 1872 की धारा 157 का विवरण :  -   जबकि माल पृथक् न किए जा सकते हों तब उपनिहिती की सम्मति के बिना किए गए मिश्रण का प्रभाव -- यदि उपनिहिती, उपनिधाता की सम्मति के बिना उपनिधाता के माल को अपने माल के साथ ऐसे प्रकार से मिश्रित कर दे कि उपनिहित माल को अन्य माल से पृथकू करना और उसे वापस परिदत्त करना असम्भव हो तो उपनिधाता उस माल की हानि के लिए उपनिहिती से प्रतिकर पाने का हकदार है।

दृष्टान्त

'क' 45 रुपये कीमत के केप के आटे का बैरल 'ख' के पास उपनिहित करता है। 'क' की सम्मति के बिना ‘ख’ उस आटे को केवल 25 रुपये प्रति बैरल के अपने देशी आटे के साथ मिश्रित करता है। 'क' को उसके आटे की हानि के लिए ‘ख’ प्रतिकर देगा।
