Section 153 Contract Act 1872 :Termination of bailment by bailee's act inconsistent with conditions - A contract of bailment is voidable at the option of the bailor, if the bailee does any act with regard to the goods bailed, inconsistent with the conditions of the bailment.

Illustration

A lets to B, for hire, a horse for his own riding. B drives the horse in his carriage. This is, at the option of A, a termination of the bailment.

भारतीय संविदा अधिनियम, 1872 की धारा 153 का विवरण :  -  उपनिहिती के ऐसे कार्य द्वारा, जो शर्तों से असंगत हो, उपनिधान का पर्यवसान -- उपनिधान की संविदा उपनिधाता के विकल्प पर शून्यकरणीय है यदि उपनिहिती उपनिहित माल के सम्बन्ध में कोई ऐसा कार्य करे जो उपनिधान की शर्तों से असंगत हो।

दृष्टान्त

‘ख’ को एक घोड़ा उसकी अपनी सवारी के लिए 'क' भाड़े पर देता है। ‘ख’ उस घोड़े को अपनी गाड़ी में चलाता है। यह 'क' के विकल्प पर उपनिधान का पर्यवसान है।
