Section 147 Contract Act 1872 :Liability of co-sureties bound in different sums - Co-sureties who are bound in different sums are liable to pay equally as far as the limits of their respective obligations permit

Illustrations

(a) A, B and C, as sureties for D, enter into three several bonds, each in a different penalty, namely, A in the penalty of 10,000 rupees, B in that of 20,000 rupees, C in that of 40,000 rupees, conditioned for D's duly accounting to E. D makes default to the extent of 30,000 rupees. A. B and C are liable to pay 10,000 rupees.

(b) A, B and C, as sureties for D, enter into three several bonds, each in a different penalty, namely, A in the penalty of 10,000 rupees, B in that of 20,000 rupees, C in that of 40,000 rupees, conditioned for D's duly accounting to E. D makes default to the extent of 40,000 rupees. A is liable to pay 10,000 rupees, and B and C 15,000 rupees each.

(c) A, B and C, as sureties for D, enter into three several bonds, each in a different penalty, namely, A in the penalty of 10,000 rupees, B in that of 20,000 rupees, C in that of 40,000 rupees, conditioned for D's duly accounting to E. D makes default to the extent of 70,000 rupees. A, B and C have to pay the full penalty of his bond.

भारतीय संविदा अधिनियम, 1872 की धारा 147 का विवरण :  -  विभिन्न राशियों के लिए आबद्ध सह-प्रतिभुओं का दायित्व -- सह-प्रतिभू, जो विभिन्न राशियों के लिए आबद्ध हैं, अपनी-अपनी बाध्यताओं की परिसीमाओं तक सामान्यतः संदाय करने के दायी हैं।

दृष्टान्त

(क) 'घ' के प्रतिभुओं के रूप में 'क', 'ख' और 'ग' इस शर्त पर आश्रित हैं कि 'ङ' को 'ग' सम्यक् रूप में लेखा देगा, पृथक्-पृथक् तीन बन्धपत्र लिख देते हैं, जिनमें से हर एक भिन्न शास्ति वाला है अर्थात् 'क' का 10,000 रुपये की, 'ख' का 20,000 रुपये की, 'ग' का 40,000 रुपये की शास्ति वाला है। ‘ग 30,000 रुपये का लेखा नहीं देता। 'क', 'ख' और 'ग' हरेक 10,000 रुपये संदाय करने के दायी हैं।

(ख) 'ग' के प्रतिभुओं की हैसियत में 'क', 'ख' और 'ग' इस शर्त पर आश्रित हैं कि 'ङ' को 'ग' सम्यक् रूप से लेखा, देगा, पृथक्-पृथक् तीन बन्धपत्र लिख देते हैं, जिनमें से हर एक भिन्न शास्ति वाला है अर्थात् 'क' का 10,000 रुपये की, 'ख' का 20,000 रुपये की, 'ग' का 40,000 रुपये की शास्ति वाला है। 'ग' 40,000 रुपये का लेखा नहीं देता। 'क' 10,000 रुपये का और 'ख' और 'ग' हर एक 15,000 रुपये का संदाय करने के दायी हैं।

(ग) 'घ' के प्रतिभुओं के रूप में 'क', 'ख' और 'ग' इस शर्त पर आश्रित हैं कि 'इ' को 'ग' सम्यक् रूप में लेखा देगा,

पृथक्-पृथक् तीन बन्धपत्र लिख देते हैं, जिनमें से हर एक भिन्न शास्ति वाला है अर्थात् 'क' का 10,0000 रुपये की, 'ख' का 20,000 रुपये की, 'ग' का 40,000 रुपये की शास्ति वाला है। 'ग' 70,000 रुपये का लेखा नहीं देता। 'क', 'ख' और 'ग' हर एक को अपने बन्धपत्र की पूरी शास्ति देनी होगी।
