Section 146 Contract Act 1872 :Co-sureties liable to contribute equally - Where two or more persons are cosureties for the same debt or duty, either jointly or severally, and whether under the same or different contracts, and whether with or without the knowledge of each other, the cosureties, in the absence of any contract to the contrary, are liable, as between themselves, to pay each an equal share of the whole debt, or of that part of it which remains unpaid by the principal debtor.

Illustrations

(a) A, B and C are sureties to D for the sum of 3,000 rupees lent to E. E makes default in payment. A, B and C are liable, as between themselves, to pay 1,000 rupees each.

(b) A, B and C are sureties to D for the sum of 1,000 rupees lent to E, and there is a contract between A, B and C that A is to be responsible to the extent of onequarter, B to the extent of one-quarter, and C to the extent of one-half. E makes default in payment. As between the sureties, A is liable to pay 250 rupees, B 250 rupees, and C 500 rupees.

भारतीय संविदा अधिनियम, 1872 की धारा 146 का विवरण :  -  सह-प्रतिभू समानतः अभिदाय करने के दायी होते हैं -- जहाँ कि दो या अधिक व्यक्ति उसी ऋण या कर्तव्य के लिए, या तो संयुक्तत: या पृथक्त: और चाहे एक हों चाहे विभिन्न संविदाओं के अधीन, और चाहे एक-दूसरे के ज्ञान में, चाहे ज्ञान के बिना, सह-प्रतिभूत हों, वहीं उन सह-प्रतिभुओं में से हर एक, तत्प्रतिकूल संविदा के अभाव में वहाँ तक, जहाँ तक उनके बीच का सम्बन्ध है, सम्पूर्ण ऋण का या उसके उस भाग का, जो मूलऋणी द्वारा असंदत्त रह गया हो, समान अंश । समानतः देने के दायी हैं।

 दृष्टान्त

(क) 'इ' को उधार दिए गए 3,000 रुपये के लिए 'घ' के 'क', 'ख', और 'ग' प्रतिभू हैं। इ' संदाय में व्यतिक्रम करता है। 'क', 'ख', 'ग', जहाँ तक उनके बीच का संबंध है, हर एक 1,000 रुपये संदत्त करने का दायी है।

(ख)'ङ' को उधार दिये गए, 1,000 रुपये के लिए 'ग' के ‘क’, ‘ख’ और ‘ग प्रतिभू हैं, और 'क', 'ख' और 'ग' के बीच यह संविदा है कि 'क' एक-चौथाई तक के लिए और 'ग' आधे तक के लिए उत्तरदायी है। 'इ' संदाय में व्यतिक्रम करता है। जहाँ तक कि प्रतिभुओं के बीच का सम्बन्ध है, 'क' 250 रुपये, ‘ख’ 250 रुपये और 'ग' 500 रुपये संदत्त करने का दायी है।
