Section 136 Contract Act 1872 :Surety not discharged when agreement made with third person to give time to principal debtor - Where a contract to give time to the principal debtor is made by the creditor with a third person, and not with the principal debtor, the surety is not discharged.

Illustration

C, the holder of an overdue bill of exchange drawn by A as surety for B, and accepted by B, contracts with M to give to B. A is not discharged.

भारतीय संविदा अधिनियम, 1872 की धारा 136 का विवरण :  -  जब कि मूल ऋणी को समय देने का करार पर-व्यक्ति से किया जाता है, जब प्रतिभू उन्मोचित नहीं होता -- जहाँ कि मूल ऋणी को समय देने की संविदा लेनदार द्वारा किसी पर-व्यक्ति से न कि मूल ऋणी से की जाती है, वहाँ प्रतिभूउन्मोचित नहीं होता।

दृष्टान्त

 'ग' एक ऐसे अतिशोध्य विनिमय-पत्र का धारक है, जिसे 'क' ने 'ख' के प्रतिभू के रूप में लिखा और 'ख' ने प्रतिग्रहीत किया है। ‘ख’ को समय देने की संविदा 'ङ' से 'ग' करता है। ‘क’ उन्मोचित नहीं होता।
