Section 130 Contract Act 1872 :Revocation of continuing guarantee — A continuing guarantee may at any time be revoked by the surety, as to future transactions, by notice to the creditor.

Illustrations

(a) A, in consideration of B's discounting, at, As request, bills of exchange for C, guarantees to B, for twelve months, the due payment of all such bills to the extent of 5,000 rupees. B discounts bills for C to the extent of 2,000 rupees. Afterwards, at the end of three months, A revokes the guarantee. This revocation discharges A from all liability to B for any subsequent discount. But A is liable to B for the 2,000 rupees, on default of C.

(b) A guarantees to B, to the extent of 10,000 rupees, that C shall pay all the bills that B shall draw upon him. B draws upon C, C accepts the bill. A gives notice of revocation. C dishonours the bill at maturity. A is liable upon his guarantee.

भारतीय संविदा अधिनियम, 1872 की धारा 130 का विवरण :  -  चलत प्रत्याभूति का प्रतिसंहरण -- चलत प्रत्याभूति का भावी संव्यवहारों के बारे में प्रतिसंहरण लेनदार को सूचना द्वारा किसी समय भी प्रतिभू कर सकेगा।

दृष्टान्त

(क) ऐसे विनिमय पत्रों को, जो 'ग' के पक्ष में हों, क' की प्रार्थना पर 'ख' द्वारा मितीकाटे पर भुगतान के प्रतिफलस्वरूप‘ख’ को ‘क’ ऐसे सब विनिमय-पत्रों पर 5,000 रुपये तक सम्यक् संदाय की प्रत्याभूति बारह मास के लिए देता है। 2,000 रुपये तक के ऐसे विनिमय-पत्रों को, जो 'ग' के पक्ष में हैं, ‘ख’ मितीकाटे पर भुगतान करता है, तत्पश्चात् तीन मास का अन्त होने पर ‘क’ उस प्रत्याभूति का प्रतिसंहरण कर लेता है। यह प्रतिसंहरण 'क' को ‘ख के प्रति किसी भी पश्चातवर्ती मितीकाटे पर पर भुगतान के लिए समस्त दायित्व से उन्मोचित कर देता है, किन्तु 'ग' द्वारा व्यतिक्रम होने पर, ‘क’ उन 2,000 रुपयों के लिए 'ख' के प्रति दायी है।

(ख) ‘ख’ को ‘क’ 1,000 रुपये तक की यह प्रत्याभूति देता है कि 'ग' उन सब विनिमय-पत्रों का, जो ‘ख’ उसके नाम लिखेगा, संदाय करेगा। 'ग' के नाम ‘ख’ विनिमय-पत्र लिखता है। 'ग' उस विनिमय-पत्र को प्रतिगृहीत करता है। 'क' प्रतिसंहरण की सूचना देता है। ‘ग उस विनिमय-पत्र को उसके परिपक्व होने पर अनादृत कर देता है। के अपनी प्रत्याभूति के अनुसार दायी है।
