Section 129 Contract Act 1872 :Continuing guarantee — A guarantee which extends to a series of transactions. is called a "continuing guarantee'.

Illustrations

(a) A, in consideration that B will employ C in collecting the rents of B's zamindari. promises B to be responsible, to the amount of 5,000 rupees, for the due collection and payment by C of those rents. This is a continuing guarantee.

(b) A guarantees payment to B, a tea-dealer, to the amount of £ 100, for any tea he may from time to time supply to C. B supplies C with tea of above the value of £ 100, and C pays B for it. Afterwards, B supplies C with tea of the value of £ 200. C fails to pay. The guarantee given by A was a continuing guarantee, and he is accordingly liable to B to the extent of £ 100.

(c) A guarantees payment to B of the price of five sacks of flour to be delivered by B to C and to be paid for in a month. B delivers five sacks to C. C pays for them. Afterwards B delivers four sacks to C, which C does not pay for. The guarantee given by A was not a continuing guarantee, and accordingly he is not liable for the price of the four sacks.

भारतीय संविदा अधिनियम, 1872 की धारा 129 का विवरण :  -   “चलत प्रत्याभूति" -- वह प्रत्याभूति जिसका विस्तार संव्यवहारों की किसी आवली पर हो, “चलत प्रत्याभूति' कहलाती है।

दृष्टान्त

(क) 'क' इस बात का प्रतिफलस्वरूप कि ‘ख’ अपनी जमींदारी के भाटकों का संग्रह करने के लिए 'ग' को नौकर रखेगा, 'ग' द्वारा उन भाटकों के सम्यक् संग्रह और संदाय के लिए 5000 रुपये की रकम तक उत्तरदायी होने का | ‘ख’ को वचन देता है। यह चलत प्रत्याभूति है।

(ख) 'क' एक चाय के व्यापारी ‘ख’ को, उस चाय के लिए, जिसका वह 'ग' को समय-समय पर प्रदाय करे, 100 पौण्ड तक की रकम का संदाय करने की प्रत्याभूति देता है। ‘ग को ‘ख’ उपर्युक्त 100 पौण्ड से अधिक मूल्य की चाय का प्रदाय करता है और 'ग' उसके लिए 'ख' को संदाय कर देता है। तत्पश्चात् 'ग' को 'ख' 200 पौण्ड मूल्य की चाय का प्रदाय करता है। ‘ग संदाय करने में असफल रहता है। ‘क’ द्वारा की गई प्रत्याभूति चलत प्रत्याभूति थी और तद्नुसार वह 'ख' के प्रति 100 पौण्ड तक का दायी है।

 (ग) 'ख' द्वारा ‘ग' को परिदत्त किए जाने वाले आटे के पाँच बोरों की कीमत के, जो एक मास में दी जाती है, संदाय के लिए 'ख' को 'क' प्रत्याभूति देता है। 'ग' को 'ख' पाँच बोरे परिदत्त करता है। ‘ग उनके लिए संदाय कर देता है। ‘ख’ तत्पश्चात् 'ग' को चार बोरे देता है, जिसका संदाय 'ग' नहीं करता है। 'क' द्वारा दी गई प्रत्याभूति चलत प्रत्याभूति नहीं थी और इसीलिए वह उन चार बोरों की कीमत के लिए दायी नहीं है
