Section 128 Contract Act 1872 :Surety's liability -- The liability of the surety is co-extensive with that of the principal debtor, unless it is otherwise provided by the contract.

A guarantees to B the payment of a bill of exchange by C, the acceptor. The bill is dishonoured by C. A is liable, not only for the amount of the bill, but also for any interest and charges which may have become due on it.

'ख' को 'क' एक विनिमय-पत्र के प्रतिग्रहीता 'ग' द्वारा संदाय की प्रत्याभूति देता है। विनिमय-पत्र 'ग' द्वारा अनादृत किया जाता है। ‘क’ न केवल उस विनिमय-पत्र की रकम के लिए, बल्कि उन ब्याज और प्रभारों के लिए भी, जो उस पर शोध्य हो गए हों, दायी है।
