Section 12 The Arms Act, 1959 in Hindi and English 



Section 12 The Arms Act, 1959:(1) The Central Government may, by notification in the Official Gazette,―

(a) direct that no person shall transport over India or any part thereof arms or ammunition of such classes and descriptions as may be specified in the notification unless he holds in this behalf a licence issued in accordance with the provisions of this Act and the rules made thereunder; or

(b) prohibit such transport altogether.

(2) Arms or ammunition trans-shipped at a seaport or an airport in India are transported within the meaning of this section.

आयुध अधिनियम, 1959 की धारा 12 का विवरण :  -  (1) केन्द्रीय सरकार, शासकीय राजपत्र में अधिसूचना द्वारा -

(क) निदेश दे सकेगी कि कोई भी व्यक्ति ऐसे वर्गों और वर्णनों के आयुधों या गोलाबारूद का, जैसे अधिसूचना में विनिर्दिष्ट किए जाएं, भारत या उसके किसी भाग पर से परिवहन तब तक नहीं करेगा जब तक कि वह इस अधिनियम या तद्धीन बनाए गए नियमों के उपबन्धों के अनुसार निकाली गई अनुज्ञप्ति इस निमित्त नहीं रखता हो, अथवा

(ख) ऐसे परिवहन का पूर्णत: प्रतिषेध कर सकेगी ।

(2) जिन आयुधों या गोलाबरूद का भारत के समुद्र पत्तन या विमान पत्तन में यानान्तरण किया जाता है, उनका इस धारा के अर्थ के अन्तर्गत परिवहन किया जाता है।
