Managing Director, Orix Auto Finance (India) Ltd. vs Shri Jagmander Singh

 On 10th February, 2006, a Division Bench in Managing Director, Orix Auto Finance (India) Ltd. vs Shri Jagmander Singh & Anr. (Civil Appeal No.1070 of 2006) while dealing with the issue of interference by High Courts in writ petitions concerning right of financiers to take re-possession of the financed vehicle, held that “essentially these are matters of contract” and unless they are shown to be unconscionable or opposed to public policy, “the scope of interference in writ petitions in such contractual matters is practically non-existent”
