Section 52 The Trade Marks Act, 1999: 

Right of registered user to take proceedings against infringement.—

(1) Subject to any agreement subsisting between the parties, a registered user may institute proceedings for infringement in his own name as if he were the registered proprietor, making the registered proprietor a defendant and the rights and obligations of such registered user in such case being concurrent with those of the registered proprietor.

(2) Notwithstanding anything contained in any other law, a registered proprietor so added as defendant shall not be liable for any costs unless he enters an appearance and takes part in the proceedings.

व्यापार चिह्न अधिनियम, 1999 की धारा 52 का विवरण : 

अतिलंघन के विरुद्ध कार्यवाही करने का रजिस्ट्रीकृत उपयोक्ता का अधिकार-(1) पक्षकारों के बीच अस्तित्ववान किसी करार के अधीन रहते हुए, कोई रजिस्ट्रीकृत उपयोक्ता रजिस्ट्रीकृत स्वत्वधारी को प्रतिवादी बनाते हुए अतिलंघन के लिए अपने स्वयं के नाम में कार्यवाही वैसे ही संस्थित कर सकेगा मानो वह रजिस्ट्रीकृत स्वत्वधारी हो और ऐसे मामले में ऐसे उपयोगकर्ता के अधिकार और बाध्यताएं रजिस्ट्रीकृत व्यापार चिह्न के स्वत्वधारी के अधिकारों और बाध्यताओं के समवर्ती हैं ।

(2) किसी अन्य विधि में किसी बात के होते हुए भी, प्रतिवादी के रूप में इस प्रकार जोड़ा गया रजिस्ट्रीकृत स्वत्वधारी किसी खर्चे के लिए दायी नहीं होगा जब तक कि वह उपसंजात होकर कार्यवाहियों में भाग नहीं लेता है ।
