Section 76 The Trade Marks Act, 1999: 

Acts not constituting infringement of certification trade marks.—

(1) Notwithstanding anything contained in this Act, the following acts do not constitute an infringement of the right to the use of a registered certification trade mark—

(a) where a certification trade mark is registered subject to any conditions or limitations entered on the register, the use of any such mark in any mode, in relation to goods to be sold or otherwise traded in any place, or in relation to goods to be exported to any market or in relation to services for use or available for acceptance in any place, country or territory or in any other circumstances, to which having regard to any such limitations, the registration does not extend;

(b) the use of a certification trade mark in relation to goods or services certified by the proprietor of the mark if, as to those goods or services or a bulk of which they form part, the proprietor or another in accordance with his authorisation under the relevant regulations has applied the mark and has not subsequently removed or obliterated it, or the proprietor has at any time expressly or impliedly consented to the use of the mark;

(c) the use of a certification trade mark in relation to goods or services adapted to form part of, or to be accessory to, other goods in relation to which the mark has been used without infringement of the right given as aforesaid or might for the time being be so used, if the use of the mark is reasonably necessary in order to indicate that the goods or services as so adapted and neither the purpose nor the effect of the use of the mark is to indicate otherwise than in accordance with the fact that the goods or services are certified by the proprietor.

(2) Clause (b) of sub-section (1) shall not apply to the case of use consisting of the application of a certification trade mark to goods or services, notwithstanding that they are such goods or services as are mentioned in that clause if such application is contrary to the regulations referred to in that clause.

(3) Where a certification trade mark is one of two or more trade marks registered under this Act, which are identical or nearly resemble each other, the use of any of those trade marks in exercise of the right to the use of that trade mark given by registration, shall not be deemed to be an infringement of the right so given to the use of any other of those trade marks.

व्यापार चिह्न अधिनियम, 1999 की धारा 76 का विवरण : 

 वे कार्य जो प्रमाणीकरण व्यापार चिह्न का अतिलंघन नहीं हैं-(1) इस अधिनियम में अन्तर्विष्ट किसी बात के होते हुए भी, रजिस्ट्रीकृत प्रमाणीकरण व्यापार चिह्न के उपयोग के अधिकार का अतिलंघन निम्नलिखित कार्यों से नहीं होता है: -

(क) जहां कोई प्रमाणीकरण व्यापार चिह्न रजिस्टर में प्रविष्ट शर्तों या मर्यादाओं के अधीन रजिस्ट्रीकृत है, वहां विक्रय किए जाने वाले या अन्यथा व्यापार किए जाने वाले माल के संबंध में या किसी बाजार को निर्यात किए जाने वाले माल के संबंध में या किसी स्थान, देश या राज्यक्षेत्र में स्वीकार करने के लिए उपलब्ध या उपयोग के लिए सेवाओं के संबंध में, या किन्हीं अन्य परिस्थितियों में जिनको, ऐसी किन्हीं मर्यादाओं को ध्यान में रखते हुए, रजिस्ट्रीकरण का विस्तार नहीं है ऐसे चिह्न का किसी ढंग से उपयोग;

(ख) चिह्न के स्वत्वधारी द्वारा प्रमाणित माल या सेवाओं के संबंध में प्रमाणीकरण व्यपार चिह्न का उपयोग, यदि उस माल या उन सेवाओं के बारे में या किसी प्रपुंज के बारे में जिसके वे भाग हैं, स्वत्वधारी या सुसंगत विनियमों के अधीन उनके प्राधिकार के अनुसार किसी अन्य ने चिह्न लगाया है और तत्पश्चात् उसे न तो हटाया है और न मिटाया है, या स्वत्वधारी ने किसी भी समय अभिव्यक्ततः या विवक्षित रूप से चिह्न के उपयोग की सहमति दी है;

(ग) प्रमाणीकरण व्यापार चिह्न का उस माल या उन सेवाओं के संबंध में उपयोग, जो अन्य माल के, जिनके संबंध में चिह्न का यथापूर्वोक्त दिए गए अधिकार के अतिलंघन के बिना उपयोग किया गया है, या तत्समय उस प्रकार उपयोग किया जा सकता है, भागरूप बनाने के लिए या उपसाधन बनाने के लिए अनुकूलित है, यदि चिह्न का उपयोग यह उपदर्शित करने के लिए युक्तियुक्त रूप से आवश्यक है कि माल या सेवाएं इस प्रकार अनुकूलित हैं, और चिह्न के उपयोग का न तो यह आशय है और न यह प्रभाव ही है कि इस तथ्य से भिन्नतः कुछ उपदर्शित किया जाए कि माल या सेवाएं स्वत्वधारी द्वारा प्रमाणित हैं ।

(2) उपधारा (1) का खंड (ख) ऐसे उपयोग के मामले में, जो किसी प्रमाणीकरण व्यापार चिह्न के किसी माल या सेवाओं को लागू करता है, इस बात के होते हुए भी कि वे ऐसे माल या सेवाएं हैं जो उस खंड में उल्लिखित हैं, उस दशा में लागू नहीं होगा यदि ऐसा लागू किया जाना उस खंड में विनिर्दिष्ट विनियमों के प्रतिकूल है ।

(3) जहां प्रमाणीकरण व्यापार चिह्न इस अधिनियम के अधीन रजिस्ट्रीकृत दो या अधिक व्यापार चिह्नों में से एक है जो एक दूसरे से तद्रूप या निकटतः सदृश है, वहां रजिस्ट्रीकरण द्वारा प्रदत्त उस व्यापार चिह्न के उपयोग के अधिकार के प्रयोग में उन व्यापार चिह्नों में से किसी का उपयोग उन व्यापार चिह्नों में से किसी अन्य के उपयोग के लिए उस प्रकार प्रदत्त अधिकार का अतिलंघन नहीं समझा जाएगा ।
