Section 13 The Trade Marks Act, 1999: 

Prohibition of registration of names of chemical elements or international non-proprietary names.—No word—

(a) which is the commonly used and accepted name of any single chemical element or any single chemical compound (as distinguished from a mixture) in respect of a chemical substance or preparation, or

(b) which is declared by the World Health Organisation and notified in the prescribed manner by the Registrar from time to time, as an international non-proprietary name or which is deceptively similar to such name, shall be registered as a trade mark and any such registration shall be deemed for the purpose of section 57 to be an entry made in the register without sufficient cause or an entry wrongly remaining on the register, as the circumstances may require.

व्यापार चिह्न अधिनियम, 1999 की धारा 13 का विवरण : 

रासायनिक तत्त्वों के नामों या अंतर्राष्ट्रीय अस्वत्वधारी नामों के रजिस्ट्रीकरण का प्रतिषेध-कोई शब्द, -

(क) जो किसी रासायनिक पदार्थ या निर्मिति की बाबत किसी एक रासायनिक तत्व या किसी एक रासायनिक यौगिक का (जो मिश्रण से भिन्न है) सामान्यतः उपयोग किया जाने वाला और स्वीकृत नाम है, या

(ख) जो विश्व स्वास्थ्य संगठन द्वारा अन्तरराष्ट्रीय अस्वत्वधारी नाम के रूप में घोषित और रजिस्ट्रार द्वारा   समय-समय पर विहित रीति में अधिसूचित किया गया है या जो ऐसे नाम के इतना समरूप है कि धोखा हो सकता है,

व्यापार चिह्न के रूप में रजिस्टर नहीं किया जाएगा और ऐसे किसी रजिस्ट्रीकरण को धारा 57 के प्रयोजनार्थ, रजिस्टर में बिना पर्याप्त कारण के की गई प्रविष्टि अथवा रजिस्टर में गलती से विद्यमान प्रविष्टि के रूप में, जैसा परिस्थितियों में अपेक्षित हो, समझा जाएगा ।
