Section 99 of MV Act 1988 :-  Preparation and publication of proposal regarding road transport service of a State transport undertaking -- (1) Where any State Government is of opinion that for the purpose of providing an efficient, adequate, economical and properly co-ordinated road transport service, it is necessary in the public interest that road transport services in general or any particular class of such service in relation to any area or route or portion thereof should be run and operated by the State transport undertaking, whether to the exclusion, complete or partial, of other persons or otherwise, the State Government may formulate a proposal regarding a scheme giving particulars of the nature of the services proposed to be rendered, the area or route proposed to be covered and other relevant particulars respecting thereto and shall publish such proposal in the Official Gazette of the State formulating such proposal and in not less than one newspaper in the regional language circulating in the area or route proposed to be covered by such scheme and also in such other manner as the State Government formulating such proposal deem fit.

(2) Notwithstanding anything contained in sub-section (1), when a proposal is published under that sub-section, then from the date of publication of such proposal, no permit shall be granted to any person, except a temporary permit during the pendency of the proposal and such temporary permit shall be valid only for a period of one year from the date of its issue or till the date of final publication of the scheme under section 100, whichever is earlier.

मोटर यान अधिनियम, 1988 की धारा 99 का विवरण :  -   राज्य परिवहन उपक्रम की सड़क परिवहन सेवा के संबंध में प्रस्थापना का तैयार किया जाना और प्रकाशन -- (1) जहां किसी राज्य सरकार की यह राय है कि एक दक्ष, यथोचित, मितव्ययी और समुचित रूप से समन्वित सड़क परिवहन सेवा उपलब्ध कराने के प्रयोजन से लोक हित में आवश्यक है कि साधारणतः सड़क परिवहन सेवाएं अथवा उसके किसी क्षेत्र या मार्ग या भाग के संबंध में किसी विशिष्ट प्रकार की ऐसी सेवा राज्य परिवहन उपक्रम द्वारा, चाहे अन्य व्यक्तियों का पूर्णतया या आंशिक रूप से अपवर्जन करके या अन्यथा, चलाई जाए और चालू रखी जाए, वहा राज्य सरकार उन सेवाओं के स्वरूप की, जिनके उपलब्ध कराए जाने की प्रस्थापना है, और उस क्षेत्र या मार्ग की, जिस पर उसे चलाने की प्रस्थापना है, विशिष्टियां और उससे संबंधित अन्य सुसंगत विशिष्टियां देते हुए एक स्कीम के संबंध में प्रस्थापना बना सकेगी और ऐसी बनाई गई प्रस्थापना को राज्य के राजपत्र में और उस क्षेत्र या मार्ग में, जिसमें ऐसी स्कीम चलाने की प्रस्थापना है, परिचालित प्रादेशिक भाषा के कम से कम एक समाचार-पत्र में, तथा ऐसी अन्य रीति से भी, जो ऐसी प्रस्थापना बनाने वाली राज्य सरकार ठीक समझे, प्रकाशित कराएगी ।

(2) उपधारा (1) में किसी बात के होते हुए भी, जब कोई प्रस्थापना उस उपधारा के अधीन प्रकाशित की जाती है, तब, ऐसी प्रस्थापना के प्रकाशन की तारीख से किसी भी व्यक्ति को प्रस्थापना के लंबित रहने के दौरान अस्थाई परमिट के सिवाय कोई परमिट, नहीं दिया जाएगा अतः ऐसा अस्थाई परमिट दिए जाने की तारीख से केवल एक वर्ष की अवधि तक या धारा 100 के अधीन स्कीम के अंतिम रूप से प्रकाशन की तारीख तक इनमें से जो भी पूर्वतर हो, विधिमान्य होगा ।
