Section 48 Evidence Act 1872 :Opinion as to existence of right or custom, when relevant -- When the Court has to form an opinion as to the existence of any general custom or right, the opinions, as to the existence of such custom or right, of persons who would be likely to know of its existence if it existed, are relevant.

Explanation -- The expression “general custom or right" includes customs or rights common to any considerable class of persons.

Illustration

The right of the villagers of a particular village to use the water of a particular well is a general right within the meaning of this section.

भारतीय साक्ष्य अधिनियम, 1872 की धारा 48 का विवरण :  -  अधिकार या रूढ़ि के अस्तित्व के बारे में रायें कब सुसंगत हैं -- जबकि न्यायालय को किसी साधारण रूढ़ि या अधिकार के अस्तित्व के बारे में राय बनानी हो, तब ऐसी रूढ़ि या अधिकार के अस्तित्व के बारे में उन व्यक्तियों की रायें सुसंगत हैं, जो यदि उसका अस्तित्व होता तो संभाव्यतः उसे जानते होते।

स्पष्टीकरण -- “साधारण रूढिया अधिकार” के अंतर्गत ऐसी रूढ़ियाँ या अधिकार आते हैं जो व्यक्तियों के किसी काफी बड़े वर्ग के लिए सामान्य हैं।

दृष्टांत

किसी विशिष्ट ग्राम के निवासियों का अमुक कूप के पानी का उपयोग करने का अधिकार इस धारा के अर्थ के अन्तर्गत साधारण अधिकार है।
