Section 109 Evidence Act 1872 :Burden of proof as to relationship in the cases of partners, landlord and tenant, principal and agent -- When the question is whether persons are partners, landlord and tenant, or principal and agent, and it has been shown that they have been acting as such, the burden of proving that they do not stand, or have ceased to stand, to each other in those relationships respectively, is on the person who affirms it.

भारतीय साक्ष्य अधिनियम, 1872 की धारा 109 का विवरण : - भागीदारों, भू-स्वामी और अभिधारी, मालिक और अभिकर्ता के मामलों में सबूत का भार -- जबकि प्रश्न यह है कि क्या कोई व्यक्ति भागीदार, भू-स्वामी और अभिधारी या मालिक और अभिकर्ता है, और यह दर्शित कर दिया गया है कि वे इस रूप में कार्य करते रहे हैं, तब यह साबित करने का भार कि क्रमशः इन संबंधों में वे परस्पर अवस्थित नहीं हैं या अवस्थित होने से परिविरत हो चुके हैं, उस व्यक्ति पर है, जो उसे प्रतिज्ञात करता है।
