Section 82 Motor Vehicles Act, 1988 in Hindi and English

Section 82 of MV Act 1988 :-  Transfer of permit -- (1) Save as provided in sub-section (2), a permit shall not be transferable from one person to another except with the permission of the transport authority which granted the permit and shall not, without such permission, operate to confer on any person to whom a vehicle covered by the permit is transferred any right to use that vehicle in the manner authorised by the permit.

(2) Where the holder of a permit dies, the person succeeding to the possession of the vehicle covered by the permit may, for a period of three months, use the permit as if it had been granted to himself :

Provided that such person has, within thirty days of the death of the holder, informed the transport authority which granted the permit of the death of the holder and of his own intention to use the permit :

Provided further that no permit shall be so used after the date on which it would have ceased to be effective without renewal in the hands of the deceased holder.

(3) The transport authority may, on application made to it within three months of the death of the holder of a permit, transfer the permit to the person succeeding to the possession of the vehicles covered by the permit :

Provided that the transport authority may entertain an application made after the expiry of the said period of three months if it is satisfied that the applicant was prevented by good and sufficient cause from making an application within the time specified.

मोटर यान अधिनियम, 1988 की धारा 82 का विवरण :  -  परमिट का अंतरण -- (1) उपधारा (2) में जैसा उपबंधित है उसके सिवाय, कोई भी परमिट उस परिवहन प्राधिकरण की, जिसने वह परमिट दिया था, अनुज्ञा के बिना एक व्यक्ति से दूसरे व्यक्ति को अंतरणीय न होगा, तथा ऐसी अनुज्ञा के बिना ऐसे किसी व्यक्ति को, जिसे उस परमिट के अंतर्गत यान अंतरित किया गया है, उस यान का उपयोग उस परमिट द्वारा प्राधिकृत रीति से करने के लिए कोई अधिकार प्रदान न करेगा ।

(2) जब परमिट के धारक की मृत्यु हो जाती है, तब परमिट के अंतर्गत यान का उत्तराधिकार से कब्जा पाने वाला व्यक्ति परमिट का उपयोग तीन मास की अवधि के लिए ऐसे कर सकेगा मानो वह उसे ही दिया गया हो :

परन्तु यह तब जबकि ऐसे व्यक्ति ने धारक की मृत्यु के तीस दिन के अंदर उस परिवहन प्राधिकरण को, जिसने परमिट दिया था, धारक की मृत्यु की और परमिट का उपयोग करने के अपने आशय की सूचना दी हो :

परन्तु यह और कि किसी भी परमिट का इस प्रकार उपयोग उस तारीख के पश्चात् नहीं किया जाएगा जिसको वह मृत धारक के पास होने पर नवीकरण के बिना प्रभावी नहीं रह जाता ।

(3) परिवहन प्राधिकरण, परमिट के धारक की मृत्यु के तीन मास के अंदर उसे आवेदन किए जाने पर परमिट उस व्यक्ति को अंतरित कर सकेगा जिसने परमिट के अंतर्गत यानों पर उत्तराधिकार से कब्जा प्राप्त किया है :

परन्तु परिवहन प्राधिकरण तीन मास की उक्त अवधि के अवसान के पश्चात् किए गए आवेदन को उस दशा में ग्रहण कर सकेगा जब उसका यह समाधान हो जाता है कि आवेदक विनिर्दिष्ट समय के भीतर आवेदन करने से उचित और पर्याप्त हेतुक से निवारित हो गया था ।
