Section 70 Motor Vehicles Act, 1988 in Hindi and English

Section 70 of MV Act 1988 :- Application for stage carriage permit -- (1) An application for a permit in respect of a stage carriage (in this Chapter referred to as a stage carriage permit) or as a reserve stage carriage shall, as far as may be, contain the following particulars, namely :-

(a) the route or routes or the area or areas to which the application relates;

(b) the type and seating capacity of each such vehicle;

(c) the minimum and maximum number of daily trips proposed to be provided and the time-table of the normal trips.

Explanation -- For the purposes of this section, section 72, section 80 and section 102, “trip” means a single journey from one point to another, and every return journey shall be deemed to be a separate trip;

(d) the number of vehicles intended to be kept in reserve to maintain the service and to provide for special occasions;

(e) the arrangements intended to be made for the housing, maintenance and repair of the vehicles, for the comfort and convenience of passengers and for the storage and safe custody of luggage;

(f) such other matters as may be prescribed.

(2) An application referred to in sub-section (1) shall be accompanied by such documents as may be prescribed.

मोटर यान अधिनियम, 1988 की धारा 70 का विवरण :  -  मंजिली-गाड़ी परमिट के लिए आवेदन -- (1) मंजिली-गाड़ी की बाबत परमिट के लिए (जिसे इस अध्याय में मंजिली-गाड़ी परमिट कहा गया है) या आरक्षित मंजिली-गाड़ी के रूप में परमिट के लिए आवेदन में यथाशक्य निम्नलिखित विशिष्टियां दी जाएंगी, अर्थात् :-

(क) वह मार्ग या वे मार्ग अथवा वह क्षेत्र या वे क्षेत्र जिससे या जिनसे वह आवेदन संबंधित है;

(ख) ऐसे प्रत्येक यान की किस्म और उसमें बैठने की जगह;

(ग) जितनी दैनिक ट्रिपे उपलब्ध कराना प्रस्थापित है उनकी न्यूनतम और अधिकतम संख्या तथा सामान्य ट्रिपों की समय-सारणी ।

स्पष्टीकरण -- इस धारा, धारा 72, धारा 80 और धारा 102 के प्रयोजनों के लिए “ट्रिपों' से एक स्थान से दूसरे स्थान तक की एकल यात्रा अभिप्रेत है, और प्रत्येक वापसी यात्रा को एक पृथक् ट्रिप समझा जाएगा;  

(घ) उन यानों की संख्या जिन्हें सेवा बनाए रखने तथा विशेष अवसरों के लिए व्यवस्था करने के वास्ते रिजर्व में रखने का इरादा है;

(ङ) वे इंतजाम जिन्हें यानों के रखने, अनुरक्षण और मरम्मत के लिए, यात्रियों के आराम और सुविधा के लिए तथा सामान के भंडारकरण तथा निरापद अभिरक्षा में रखने के लिए करने का इरादा है;

(च) ऐसे अन्य विषय जो विहित किए जाएं ।

(2) उपधारा (1) में निर्दिष्ट आवेदन के साथ ऐसे दस्तावेज होंगे जो विहित किए जाएं ।
