Section 68 of CrPC 1973 :- 68. Proof of service in such cases and when serving officer not present — (1) When a summons issued by a Court it served outside its local jurisdiction and in any case where the officer who has served a summons is not present at the hearing of the case, an affidavit, purporting to be made before a Magistrate, that such summons has been served and a duplicate of the summons, purporting to be endorsed (in the manner provided by section 62 or section 64) by the person to whom it was delivered or tendered or with whom it was left, shall be admissible in evidence and the statements made therein shall be deemed to be correct unless and until the contrary is proved.

(2) The affidavit mentioned in this section may be attached to the duplicate of the summons and returned to the Court.

दंड प्रक्रिया संहिता 1973 की धारा 68 का विवरण :  -  68. ऐसे मामलों में और जब तामील करने वाला अधिकारी उपस्थित न हो तब तामील का सबूत -- (1) जब न्यायालय द्वारा जारी किए गए समन की तामील उसकी स्थानीय अधिकारिता के बाहर की गई है तब और ऐसे किसी मामले में जिसमें वह अधिकारी जिसने समन की तामील की है, मामले की सुनवाई के समय उपस्थित नहीं है मजिस्ट्रेट के समक्ष किया गया तात्पर्यत यह शपथपत्र कि ऐसे समन की तामील हो गई है और समन की दूसरी प्रति, जिसका उस व्यक्ति द्वारा जिसको समन परिदत्त या निविदत्त किया गया था, या जिसके पास वह छोड़ा गया था (धारा 62 या धारा 64 में उपबंधित प्रकार से), पृष्ठांकित होना तात्पर्यत है, साक्ष्य में ग्राह्य होगी और जब तक तत्प्रतिकूल साबित न किया जाए, उसमें किए गए कथन सही माने जाएँगे।

(2) इस धारा में वर्णित शपथ पत्र समन की दूसरी प्रति से संलग्न किया जा सकता है और उस न्यायालय को भेजा जा सकता है।
