Section 65 Motor Vehicles Act, 1988 in Hindi and English

Section 65 of MV Act 1988 :-  Power of the State Government to make rules -- (1) A State Government may make rules for the purpose of carrying into effect the provisions of this Chapter other than the matters specified in section 64.

(2) Without prejudice to the generality of the foregoing power, such rules may provide for--

(a) the conduct and hearing of appeals that may be preferred under this Chapter (the fees to be paid in respect of such appeals and the refund of such fees);

(b) the appointment, functions and jurisdiction of registering and other prescribed authorities;

(c) the exemption of road-rollers, graders and other vehicles designed and used solely for the construction, repair and cleaning of roads from all or any of the provisions of this Chapter and the rules made thereunder and the conditions governing such exemption;

(d) the issue or renewal of certificates of registration and fitness and duplicates of such certificates to replace the certificates lost, destroyed or mutilated;

(e) the production of certificates of registration before the registering authority for the revision of entries therein of particulars relating to the gross vehicle weight;

(f) the temporary registration of motor vehicles, and the issue of temporary certificate of registration and marks [under the proviso to section 43];

(g) the manner in which the particulars referred to in sub-section (2) of section 58 and other prescribed particulars shall be exhibited;

(h) the exemption of prescribed persons or prescribed classes of persons from payment of all or any portion of the fees payable under this Chapter;

(i) the forms, other than those prescribed by the Central Government, to be used for the purpose of this Chapter;

(j) the communication between registering authorities of particulars of certificates of registration and by owners of vehicles registered outside the State of particulars of such vehicles and of their registration;

(k) the amount or amounts under sub-section (13) of section 41 or sub-section (7) of section 47 or sub-section (4) of section 49 or sub-section (5) of section 50;

(l) the extension of the validity of certificates of fitness pending consideration of applications for their renewal;

(m) the exemption from the provisions of this Chapter, and the conditions and fees for exemption, of motor vehicles in the possession of dealers;

(n) the form in which and the period within which the return under section 62 shall be sent;

(p) any other matter which is to be or may be prescribed.

मोटर यान अधिनियम, 1988 की धारा 65 का विवरण :  -   राज्य सरकार की नियम बनाने की शक्ति -- (1) राज्य सरकार धारा 64 में विनिर्दिष्ट विषयों से भिन्न इस अध्याय के उपबंधों को क्रियान्वित करने के प्रयोजन के लिए नियम बना सकेगी।

(2) पूर्वगामी शक्ति की व्यापकता पर प्रतिकूल प्रभाव डाले बिना, ऐसे नियमों में निम्नलिखित के लिए उपबंध किया जा सकता है, अर्थात् :-

(क) उन अपीलों का संचालन और सुनवाई जो इस अध्याय के अधीन की जाएं (ऐसी अपीलों के बारे में दी जाने वाली फीसें और ऐसी फीसों का प्रतिदाय);

(ख) रजिस्ट्रीकर्ता और अन्य विहित प्राधिकारियों की नियुक्ति, कृत्य और अधिकारिता;

(ग) रोड रोलर, ग्रेडर और ऐसे अन्य यानों को, जिन्हें सड़कों के निर्माण, मरम्मत और उनकी सफाई के लिए अनन्य रूप से बनाया गया है और उपयोग में लाया जाता है इस अध्याय के और उसके अधीन बनाए गए नियमों के सभी या किन्हीं उपबंधों से छूट और ऐसी छूट को शासित करने वाली शर्ते;

(घ) रजिस्ट्रीकरण और ठीक हालत में होने के प्रमाण-पत्र और खोए, नष्ट या कटे-फटे प्रमाण-पत्रों के बदले में उन प्रमाण-पत्रों की दूसरी प्रतियां देना या उनका नवीकरण करना;

(ङ) रजिस्ट्रीकरण प्रमाण-पत्रों को यान के कुल वजन से संबंधित उसमें की विशिष्टियों की प्रविष्टियों का पुनरीक्षण करने के लिए, रजिस्ट्रीकर्ता प्राधिकारी के समक्ष पेश करना;

(च) धारा 43 के परंतुक के अधीन मोटर यानों का अस्थाई रजिस्ट्रीकरण और अस्थाई रजिस्ट्रीकरण प्रमाण-पत्र और चिन्हों का दिया जाना;

(छ) वह रीति जिससे धारा 58 की उपधारा (2) में निर्दिष्ट विशिष्टियां और अन्य विहित विशिष्टियां प्रदर्शित की जाएंगी; 

(ज) जो फीसें इस अध्याय के अधीन देय हैं उन सभी को या उनके किसी भाग को देने से विहित व्यक्तियों या विहित वर्गों के व्यक्तियों को छूट;

(झ) केन्द्रीय सरकार द्वारा विहित प्ररूपों से भिन्न ऐसे प्ररूप जो इस अध्याय के प्रयोजनों के  लिए उपयोग में लाए जाने हैं;

(ञ) रजिस्ट्रीकरण प्रमाण-पत्रों की विशिष्टियों का रजिस्ट्रीकृत प्राधिकारियों के बीच संसूचित किया जाना तथा उन यानों के स्वामियों द्वारा, जो राज्य के बाहर रजिस्ट्रीकृत हैं, उन यानों को और उनके रजिस्ट्रीकरण की विशिष्टियों का संसूचित किया जाना;

(ट) धारा 41 की उपधारा (13) या धारा 47 की उपधारा (7) या धारा 49 की उपधारा (4)  या धारा 50 की उपधारा (5) के अधीन रकम या रकमें;

(ठ) ठीक हालत में होने के प्रमाण-पत्रों के नवीकरण के लिए आवेदनों के विचारार्थ लंबित रहने तक उन प्रमाण-पत्रों की विधिमान्यता की अवधि का बढ़ाया जाना;

(ड) जो मोटर यान व्यवहारियों के कब्जे में हैं उन्हें इस अध्याय के उपबंधों से छूट और उस छूट के लिए शर्ते और फीस;

(ढ) वह प्ररूप जिसमें और वह अवधि जिसके भीतर धारा 62 के अधीन विवरणी भेजी जाएगी;

(त) कोई अन्य विषय जो विहित किया जाना है या किया जाए
