Section 479 of CrPC 1973 :- 479. Cases in which Judge or Magistrate is personally interested -

No Judge or Magistrate shall, except with the permission of the Court to which an appeal lies for his Court, try or commit for trial any case to or in which he is a party, or personally interested, and no Judge or Magistrate shall hear an appeal from any judgement or order passed or made by himself.

Explanation - A Judge or Magistrate shall not be deemed to be a party to, or personally interested in any case by reason only that he is concerned therein in a public capacity, or by reason only that he has viewed the place in which an offence is alleged to have been committed or any other place in which any other transaction material to the case is alleged to have occurred and made an inquiry in connection with the case.

दंड प्रक्रिया संहिता 1973 की धारा 479 का विवरण :  -  479. वह मामला जिसमें न्यायाधीश या मजिस्ट्रेट वैयक्तिक रूप से हितबद्ध है --

कोई न्यायाधीश या मजिस्ट्रेट किसी ऐसे मामले का, जिसमें वह पक्षकार है, या वैयक्तिक रूप से हितबद्ध है, उस न्यायालय की अनुज्ञा के बिना, जिसमें उसके न्यायालय से अपील होती है न तो विचारण करेगा और न उसे विचारणार्थ सुपुर्द करेगा और न कोई न्यायाधीश या मजिस्ट्रेट अपने द्वारा पारित या किए गए किसी निर्णय या आदेश की अपील ही सुनेगा।

स्पष्टीकरण -- कोई न्यायाधीश या मजिस्ट्रेट किसी मामले में केवल इस कारण से कि वह उससे सार्वजनिक हैसियत में संबद्ध है या केवल इस कारण से कि उसने उस स्थान का, जिसमें अपराध का होना अभिकथित है, या किसी अन्य स्थान का, जिसमें मामले के लिए महत्वपूर्ण किसी अन्य संव्यवहार का होना अभिकथित है, अवलोकन किया है और उस मामले के संबंध में जांच की है इस धारा के अर्थ में पक्षकार या वैयक्तिक रूप से हितबद्ध न समझा जाएगा।
