Section 405 of CrPC 1973 :- 405. High Court's order to be certified to lower Court -- When a case is revised under this Chapter by the High Court or a Sessions Judge, it or he shall, in the manner provided by section 388, certify its decision or order to the Court by which the finding, sentence or order revised was recorded or passed and the Court to which the decision or order is so certified shall thereupon make such orders as are conformable to the decision so certified; and, if necessary, the record shall be amended in accordance therewith.

दंड प्रक्रिया संहिता 1973 की धारा 405 का विवरण :  -  405. उच्च न्यायालय के आदेश का प्रमाणित करके निचले न्यायालय को भेजा जाना -- जब उच्च न्यायालय या सेशन न्यायाधीश द्वारा कोई मामला इस अध्याय के अधीन पुनरीक्षित किया जाता है तब वह धारा 388 द्वारा उपबंधित रीति से अपना विनिश्चय या आदेश प्रमाणित करके उस न्यायालय को भेजेगा, जिसके द्वारा पुनरीक्षित निष्कर्ष, दण्डादेश या आदेश अभिलिखित किया गया या पारित किया गया था, और तब वह न्यायालय, जिसे विनिश्चय या आदेश ऐसे प्रमाणित करके भेजा गया है ऐसे आदेश करेगा, जो ऐसे प्रमाणित विनिश्चय के अनुरूप है और यदि आवश्यक हो तो अभिलेख में तद्नुसार संशोधन कर दिया जाएगा। |
