Section 388 of CrPC 1973 :- 388. Order of High Court on appeal to be certified to lower Court —

(1) Whenever a case is decided on appeal by the High Court under this Chapter, it shall certify its judgment or order to the Court by which the finding, sentence or order appealed against was recorded or passed and if such Court is that of a Judicial Magistrate other than the Chief Judicial Magistrate, the High Court's judgment or order shall be sent through the Chief Judicial Magistrate; and if such Court is that of an Executive Magistrate, the High Court's judgment or order shall be sent through the District Magistrate.

(2) The Court to which the High Court certifies its judgment or order shall thereupon make such orders as are conformable to the judgment or order of the High Court; and, if necessary, the record shall be amended in accordance therewith.

दंड प्रक्रिया संहिता 1973 की धारा 388 का विवरण :  -  388. अपील में उच्च न्यायालय के आदेश का प्रमाणित करके निचले न्यायालय को भेजा जाना --

(1) जब कभी अपील में कोई मामला उच्च न्यायालय द्वारा इस अध्याय के अधीन विनिश्चित किया जाता है तब वह अपना निर्णय या आदेश प्रमाणित करके उस न्यायालय को भेजेगा जिसके द्वारा वह निष्कर्ष, दण्डादेश या आदेश, जिसके विरुद्ध अपील की गई थी अभिलिखित किया गया या पारित किया गया था और यदि ऐसा न्यायालय मुख्य न्यायिक मजिस्ट्रेट से भिन्न न्यायिक मजिस्ट्रेट का है तो उच्च न्यायालय का निर्णय या आदेश मुख्य न्यायिक मजिस्ट्रेट की मार्फत भेजा जाएगा; और यदि ऐसा न्यायालय कार्यपालक मजिस्ट्रेट का है तो उच्च न्यायालय का निर्णय या आदेश जिला मजिस्ट्रेट की मार्फत भेजा जाएगा।

(2) तब वह न्यायालय, जिसे उच्च न्यायालय अपना निर्णय या आदेश प्रमाणित करके भेजे ऐसे आदेश करेगा जो उच्च न्यायालय के निर्णय या आदेश के अनुरूप हो; और यदि आवश्यक हो तो अभिलेख में तद्नुसार संशोधन कर दिया जाएगा।
