Section 38 Motor Vehicles Act, 1988 in Hindi and English

Section 38 of MV Act 1988 :-  Power of State Government to make rules -- (1) A State Government may make rules for the purpose of carrying into effect the provisions of this Chapter.

(2) Without prejudice to the generality of the foregoing power, such rules may provide for-

(a) the appointment, jurisdiction, control and function of licensing authorities and other prescribed authorities under this Chapter;

(b) the conditions subject to which drivers of stage carriages performing the functions of a conductor and persons temporarily employed to act as conductors may be exempted from the provisions of subsection (1) of section 29;

(c) the minimum educational qualifications of conductors; their duties and functions and the conduct of persons to whom conductor's licences are issued;

(d) the form of application for conductor's licences or for renewal of such licences and the particulars it may contain;

(e) the form in which conductor's licences may be issued or renewed and the particulars it may contain;

(f) the issue of duplicate licences to replace licences lost, destroyed or mutilated, the replacement of photographs which have become obsolete and the fees to be charged therefor,

(g) the conduct and hearing of appeals that may be preferred under this Chapter, the fees to be paid in respect of such appeals and the refund of such fees :

Provided that no fee so fixed shall exceed twenty-five rupees;

(h) the badges and uniform to be worn by conductors of stage carriages and the fees to be paid in respect of such badges;

(i) the grant of the certificates referred to in sub-section (3) of section 30 by registered medical practitioners and the form of such certificate;

(j) the conditions subject to which, and the extent to which, a conductor's licence issued in another State shall be effective in the State;

(k) the communication of particulars of conductor's licences from one authority to other authorities; and

(l) any other matter which is to be, or maybe, prescribed.

मोटर यान अधिनियम, 1988 की धारा 38 का विवरण :  -  राज्य सरकार की नियम बनाने की शक्ति -- (1) राज्य सरकार इस अध्याय के उपबंधों को कार्यान्वित करने के प्रयोजन के लिए नियम बना सकेगी ।

(2) पूर्वगामी शक्ति की व्यापकता पर प्रतिकूल प्रभाव डाले बिना, ऐसे नियमों में निम्नलिखित के लिए उपबंध हो सकेगा :-

(क) इस अध्याय के अधीन अनुज्ञापन प्राधिकारियों और अन्य विहित प्राधिकारियों की नियुक्ति, अधिकारिता, नियंत्रण और कृत्य;

(ख) वे शर्ते जिनके अधीन रहते हुए कंडक्टर के कृत्यों का पालन करने वाले मंजिली गाड़ियों के ड्राइवरों को और कंडक्टरों के रूप में कार्य करने के लिए अस्थाई रूप से नियोजित व्यक्तियों को धारा 29 की उपधारा (1) के उपबंधों से छूट दी जा सकेगी;     

(ग) कंडक्टरों की न्यूनतम शैक्षिक अर्हताएं, उनके कर्त्तव्य और कृत्य और उन व्यक्तियों के आचरण, जिनको कंडक्टर अनुज्ञप्तियाँ दी गई हैं;

(घ) कंडक्टर अनुज्ञप्तियों के लिए अथवा ऐसी अनुज्ञप्तियों के नवीकरण के लिए आवेदन के प्ररूप और वे विशिष्टियाँ, जो उसमें हो सकेंगी;

(ङ) वह प्ररूप, जिसमें कंडक्टर अनुज्ञप्तियाँ दी जा सकेंगी या उनका नवीकरण किया जा सकेगा और वे विशिष्टियां, जो उसमें हो सकेंगी;

(च) किन्हीं खोई, नष्ट या कटी-फटी अनुज्ञप्तियों के बदले में दूसरी अनुज्ञप्तियों का दिया जाना; ऐसी फोटो के बदले में, जो पुरानी पड़ गई है, नई फोटो रखना और उनके लिए प्रभारित की जाने वाली फीसें;

(छ) इस अध्याय के अधीन की जाने वाली अपीलों का संचालन और उनकी सुनवाई, ऐसी अपीलों की बाबत देय फीसें और ऐसी फीसों का वापस दिया जाना:

परन्तु इस प्रकार नियत की जाने वाली कोई फीस पच्चीस रुपए से अधिक नहीं होगी |

(ज) मंजिली गाड़ियों के कंडक्टरों द्वारा पहनी जाने वाली वर्दी और लगाए जाने वाले बैज, और ऐसे बैजों के लिए दी जाने वाली फीसें;

(झ) रजिस्ट्रीकृत चिकित्सा व्यवसायियों द्वारा धारा 30 की उपधारा (3) में निर्दिष्ट  प्रमाण-पत्रों का दिया जाना, और ऐसे प्रमाण-पत्रों के प्ररूप;

(ञ) वे शर्ते जिनके अधीन रहते हए और वह विस्तार जिस तक अन्य राज्य में दी गई या कंडक्टर अनुज्ञप्ति राज्य में प्रभावी होगी:

(ट) कंडक्टर अनुज्ञप्तियों की विशिष्टियों की एक प्राधिकारी से अन्य प्राधिकारियों को संसूचना; और

(ठ) कोई अन्य विषय जो विहित किया जाना है या किया जाए ।
