Section 23 Indian Evidence Act 1872 in Hindi and English 



Section 23 Evidence Act 1872 : Admissions in civil cases, when relevant -- In civil cases no admission is relevant, if it is made either upon an express condition that evidence of it is not to be given, or under circumstances from which the Court can infer that the parties agreed together that evidence of it should not be given.

Explanation -- Nothing in this section shall be taken to exempt any barrister, pleader, attorney or vakil from giving evidence of any matter of which he may be compelled to give evidence under section 126.

भारतीय साक्ष्य अधिनियम, 1872 की धारा 23 का विवरण :  -  सिविल मामलों में स्वीकृतियाँ कब सुसंगत होती हैं -- सिविल मामलों में कोई भी स्वीकृति सुसंगत नहीं है, यदि वह या तो इस अभिव्यक्त शर्त पर की गई हो कि उसका साक्ष्य नहीं दिया जाएगा या ऐसी परिस्थितियों के अधीन दी गई हो जिनसे न्यायालय यह अनुमान कर सके कि पक्षकार इस बात पर परस्पर सहमत हो गए थे कि उसका साक्ष्य नहीं दिया जाना चाहिए।


स्पष्टीकरण -- इस धारा की कोई भी बात किसी बैरिस्टर, प्लीडर, अटर्नी या वकील को किसी ऐसी बात का साक्ष्य देने से छूट देने वाली नहीं मानी जाएगी जिसका साक्ष्य देने के लिए धारा 126 के अधीन उसे विवश किया जा सकता है।
