Section 22 Motor Vehicles Act, 1988 in Hindi and English



Section 22 of MV Act 1988 :-  Suspension or cancellation of driving licence on conviction -- (1) Without prejudice to the provisions of sub-section (3) of section 20 where a person, referred to in sub-section (1) of section 21 is convicted of an offence of causing, by such dangerous driving as is referred to in section 184 of any class or description of motor vehicle the death of, or grievous hurt to, one or more persons, the Court by which such person is convicted may cancel, or suspend for such period as it may think fit, the driving licence held by such person in so far as it relates to that class or description of motor vehicle.

(2) Without prejudice to the provisions of sub-section (2) of section 20, if a person, having been previously convicted of an offence punishable under section 185 is again convicted of an offence punishable under that section, the Court, making such subsequent conviction, shall, by order, cancel the driving licence held by such person.

(3) If a driving licence is cancelled or suspended under this section, the Court shall take the driving licence in its custody, endorse the cancellation or, as the case may be, suspension, thereon and send the driving licence so endorsed to the authority by which the licence was issued or last renewed and such authority shall, on receipt of the licence, keep the licence in its safe custody, and in the case of a suspended licence, return the licence to the holder thereof after the expiry of the period of suspension on an application made by him for such return :

Provided that no such licence shall be returned unless the holder thereof has, after the expiry of the period of suspension, undergone and passed, to the satisfaction of the licensing authority by which the licence was issued or last renewed, a fresh test of competence to drive referred to in sub-section (3) of section 9 and produced a medical certificate in the same form and in same manner as is referred to in subsection (3) of section 8.

(4) If a licence to drive a particular class or description of motor vehicles is cancelled or suspended under this section, the person holding such a licence shall be debarred from holding, or obtaining, any licence to drive such particular class or description of motor vehicles so long as the cancellation or suspension of the driving licence remains in force.

मोटर यान अधिनियम, 1988 की धारा 22 का विवरण :  -  दोषसिद्धि पर चालान-अनुज्ञप्ति का निलंबन या रद्दकरण -- (1) धारा 20 की उपधारा (3) के उपबंधों पर प्रतिकूल प्रभाव डाले बिना, जहां धारा 21 की उपधारा (1) में निर्दिष्ट कोई व्यक्ति, किसी वर्ग या वर्णन के मोटर यान को ऐसे खतरनाक रूप से चलाने के कारण, जैसा कि धारा 184 में निर्दिष्ट है, एक या अधिक व्यक्तियों की मृत्यु या घोर उपहति कारित करने के अपराध के लिए दोषसिद्ध किया गया है, वहां ऐसे व्यक्ति को दोषसिद्ध करने वाला न्यायालय ऐसे व्यक्ति द्वारा धारित चालन-अनुज्ञप्ति को, जहां तक वह उस वर्ग या वर्णन के मोटर यान के संबंध में है, ऐसी अवधि के लिए रद्द या निलंबित कर सकेगा, जो वह ठीक समझे।

(2) धारा 20 की उपधारा (2) के उपबंधों पर प्रतिकूल प्रभाव डाले बिना, यदि कोई व्यक्ति, जो धारा 185 के अधीन दंडनीय किसी अपराध के लिए पहले ही दोषसिद्ध किया जा चुका है, उस धारा के अधीन दंडनीय किसी अपराध के लिए पुनः दोषसिद्ध किया जाता है तो ऐसी पश्चात्वर्ती दोषसिद्धि करने वाला न्यायालय ऐसे व्यक्ति द्वारा धारित चालन-अनुज्ञप्ति को, आदेश द्वारा, रद्द करेगा।

(3) यदि कोई चालन-अनुज्ञप्ति इस धारा के अधीन रद्द या निलंबित की जाती है तो न्यायालय चालन-अनुज्ञप्ति को अपनी अभिरक्षा में ले लेगा, उस पर, यथास्थिति, रद्दकरण या निलंबन का पृष्ठांकन करेगा और इस प्रकार पृष्ठांकित चालन-अनज्ञप्ति उस प्राधिकारी को भेजेगा, जिसने अनज्ञप्ति जारी की थी या उसका अंतिम बार नवीकरण किया था, और वह प्राधिकारी अनुज्ञप्ति की प्राप्ति पर अनुज्ञप्ति को अपनी सुरक्षित अभिरक्षा में रखेगा और निलंबित अनुज्ञप्ति की दशा में अनुज्ञप्ति को निलंबन की अवधि समाप्त हो जाने पर, उसके धारक को, ऐसी वापसी के लिए उसके द्वारा किए गए आवेदन पर वापस करेगा :

परन्तु ऐसी कोई अनुज्ञप्ति तब तक वापस नहीं की जाएगी जब तक कि उसका धारक निलंबन की अवधि समाप्त होने के पश्चात् उस अनुज्ञापन प्राधिकारी के, जिसने अनुज्ञप्ति जारी की थी या उसका अंतिम बार नवीकरण किया था, समाधानप्रद रूप में धारा 9 की उपधारा (3) में निर्दिष्ट यान चलाने की सक्षमता का परीक्षण नए सिरे से नहीं दे देता तथा उसमें उत्तीर्ण नहीं हो जाता और धारा 8 की उपधारा (3) में यथानिर्दिष्ट प्ररूप और रीति में चिकित्सा प्रमाण-पत्र प्रस्तुत नहीं कर देता ।

(4) यदि किसी विशिष्ट वर्ग या वर्णन के मोटर यान को चलाने के लिए कोई अनुज्ञप्ति इस धारा के अधीन रद्द या निलंबित की जाती है तो ऐसी अनुज्ञप्ति को धारण करने वाला व्यक्ति ऐसे विशिष्ट वर्ग या वर्णन के मोटर यानों को चलाने के लिए कोई अनुज्ञप्ति धारण करने से या उसे अभिप्राप्त करने से तब तक के लिए विवर्जित हो जाएगा जब तक चालन-अनुज्ञप्ति का रद्दकरण या निलंबन प्रवृत्त रहता है ।
