Section 205 Motor Vehicles Act, 1988 in Hindi and English



Section 205 of MV Act 1988 :- Presumption of unfitness to drive -- In any proceeding for an offence punishable under section 185 if it is proved that the accused when requested by a police officer at any time so to do, had refused, omitted or failed to consent to the taking of or providing a specimen of his breath for a breath test or a specimen of his blood for a laboratory test, his refusal, omission or failure may, unless reasonable cause therefor is shown, be presumed to be a circumstance supporting any evidence given on behalf of the prosecution, or rebutting any evidence given on behalf of the defence, with respect to his condition at that time.

मोटर यान अधिनियम, 1988 की धारा 205 का विवरण :  -  मोटर यान चलाने की अयोग्यता की उपधारणा -- धारा 185 के अधीन दण्डनीय किसी अपराध के लिए किसी कार्यवाही में यदि यह साबित हो जाता है कि किसी अभियुक्त ने, जब किसी पुलिस अधिकारी द्वारा किसी समय ऐसा करने के लिए अनुरोध किया गया था, श्वास-परीक्षण के लिए श्वास का नमूना अथवा प्रयोगशाला परीक्षण के लिए उसके रक्त का नमूना लिए जाने या देने से इन्कार किया था, ऐसा नहीं किया था या करने में असफल रहा था, तो उसका इन्कार, ऐसा न करना या असफलता, जब तक कि उसके लिए उचित कारण न दर्शित किया गया हो, उस समय उसकी दशा के बारे में, अभियोजन की ओर से दिए गए किसी साक्ष्य का समर्थन करने वाला या प्रतिरक्षा की ओर से दिए गए किसी साक्ष्य का खंडन करने वाला माना जाएगा ।
