Section 183 Motor Vehicles Act, 1988 in Hindi and English

Section 183 of MV Act 1988 :- Driving at excessive speed, etc. -- (1) Whoever drives [or causes any person who is employed by him or subjects someone under his control to drive] a motor vehicle in contravention of the speed limits referred to in section 112 shall be punishable [in the following manner, namely:-

(i) where such motor vehicle is a light motor vehicle with fine which shall not be less than one thousand rupees but may extend to two thousand rupees;

(ii) where such motor vehicle is a medium goods vehicle or a mediurn passenger vehicle or a heavy goods vehicle or a heavy passenger vehicle with fine which shall not be less than two thousand rupees, but may extend to four thousand rupees; and

(iii) for the second or any subsequent offence under this sub-section the driving licence of such driver shall be impounded as per the provisions of the sub-section (4) of section 206.]

(3) No person shall be convicted of any offence punishable under sub-section (1) solely on the evidence of one witness to the effect that in the opinion of the witness such person was driving at a speed which was unlawful, unless that opinion is shown to be based on an estimate obtained by the use of some mechanical [or electronic] device.

(4) The publication of a time table under which or the giving of any direction that, any journey or part of a journey is to be completed within a specified time shall, if in the opinion of the Court it is not practicable in the circumstances of the case for that journey or part of a journey to be completed in the specified time without contravening the speed limits referred to in section 112 be prima facie evidence that the person who published the time table or gave the direction has committed an offence punishable under [sub-section (1)].

मोटर यान अधिनियम, 1988 की धारा 183 का विवरण :  -  अत्यधिक गति आदि से चलाना -- (1) जो कोई धारा 112 में निर्दिष्ट गति-सीमा का उल्लंघन करके मोटर यान चलाएगा [या किसी ऐसे व्यक्ति से, जो उसके द्वारा नियोजित है या उसके नियंत्रण के अधीन किसी व्यक्ति से उसे चलवाएगा], वह जुर्माने से, [निम्नलिखित रीति में दण्डनीय होगा, अर्थात्:-

(i) जहां कोई ऐसा मोटर यान हल्का मोटर यान है वहां ऐसे जुर्माने से, जो एक हजार रुपए से कम नहीं होगा किन्तु दो हजार रुपए तक हो सकेगा;

(ii) जहां ऐसा मोटर यान मध्यम माल यान या मध्यम यात्री यान या भारी माल यान कि या भारी यात्री यान है वहां ऐसे जुर्माने से, जो दो हजार रुपए से कम नहीं होगा किन्तु चार हजार रुपए तक का हो सकेगा; और

(iii) इस उपधारा के अधीन दूसरे या किसी पश्चातवर्ती अपराध के लिए ऐसे चालक की चालन अनुज्ञप्ति धारा 206 की उपधारा (4) के उपबंधों के अनुसार परिबद्ध कर ली जाएगी ।]

(3) कोई व्यक्ति केवल एक साक्षी के इस आशय के साक्ष्य पर ही कि उस साक्षी की राय में ऐसा व्यक्ति ऐसी गति से यान को चला रहा था जो विधिविरुद्ध है, तब तक दोषसिद्ध नहीं किया जाएगा जब तक उस राय की बाबत यह दर्शित नहीं कर दिया जाता है कि वह किसी यांत्रिक [या इलेक्ट्रॉनिक] युक्ति के उपयोग से अभिप्राप्त प्राक्कलन पर आधारित है।

(4) ऐसी समय सारणी का प्रकाशन जिसके अधीन ऐसे किसी निदेश का दिया जाना जिसके अनुसार कोई यात्रा या यात्रा का भाग विनिर्दिष्ट समय के अन्दर पूरा कर लिया जाना है, उस दशा में, जिसमें न्यायालय की यह राय है कि मामले की परिस्थितियों में यह साक्ष्य नहीं है कि वह यात्रा या यात्रा का भाग धारा 122 में निर्दिष्ट गति-सीमा का उल्लंघन किए बिना विनिर्दिष्ट समय के अन्दर पूरा कर लिया जाए, इस बात का प्रथमदृष्टया साक्ष्य होगा कि जिस व्यक्ति ने वह समय सारणी प्रकाशित की है या वह निदेश दिया है उसने [उपधारा (1)] के अधीन दण्डनीय अपराध किया है।
