Section 182A of MV Act 1988 :- Punishment for offences relating to construction, maintenance, sale and alteration of motor vehicles and components. -- (1) Whoever, being a manufacturer, importer or dealer of motor vehicles, sells or delivers or alters or offers to sell or deliver or alter, a motor vehicle that is in contravention of the provisions of Chapter VII or the rules and regulations made thereunder, shall be punishable with imprisonment for a term which may extend to one year, or with fine of one lakh rupees per such motor vehicle or with both:

Provided that no person shall be convicted under this section if he proves that, at the time of sale or delivery or alteration or offer of sale or delivery or alteration of such motor vehicle, he had disclosed to the other party the manner in which such motor vehicle was in contravention of the provisions of Chapter VII or the rules and regulations made thereunder.

(2) Whoever, being a manufacturer of motor vehicles, fails to comply with the provisions of Chapter VII or the rules and regulations made thereunder, shall be punishable with imprisonment for a term which may extend to one year or with fine which may extend to one hundred crore rupees or with both.

(3) Whoever, sells or offers to sell, or permits the sale of any component of a motor vehicle which has been notified as a critical safety component by the Central Government and which does not comply with Chapter VII or the rules and regulations made thereunder shall be punishable with imprisonment for a term which may extend to one year or with fine of one lakh rupees per such component or with both.

(4) Whoever, being the owner of a motor vehicle, alters a motor vehicle, including by way of retrofitting of motor vehicle parts, in a manner not permitted under the Act or the rules and regulations made thereunder shall be punishable with imprisonment for a term which may extend to six months, or with fine of five thousand rupees per such alteration or with both.

मोटर यान अधिनियम, 1988 की धारा 182क का विवरण :  -  मोटर यानों और उनके संघटकों के संनिर्माण, रखरखाव, विक्रय और परिवर्तन से संबंधित अपराधों के लिए दंड -- (1) जो कोई मोटर यानों का विनिर्माता, आयातकर्ता या ब्यौहारी होने के कारण, मोटर यान का विक्रय करता है या परिदान करता है या उसका परिवर्तन करता है या विक्रय करने या परिदान करने या परिवर्तन करने की प्रस्थापना करता है जो अध्याय सात या उसके अधीन बनाए गए नियमों और विनियमों के उपबंधों के उल्लंघन में है, ऐसी अवधि के कारावास से जो एक वर्ष तक की हो सकेगी या ऐसे जुर्माने से जो ऐसे प्रत्येक मोटर यान के लिए एक लाख रुपए तक का हो सकेगा या दोनों से दंडनीय होगा :

परंतु कोई व्यक्ति इस धारा के अधीन सिद्धदोष नहीं ठहराया जाएगा यदि वह यह साबित कर देता है कि ऐसे मोटर यान के विक्रय या परिदान या परिवर्तन के समय उसने उस रीति, जिसमें ऐसा मोटर यान अध्याय 7 या उसके अधीन बनाए गए नियमों और विनियमों के उपबंधों के उल्लंघन में था, के अन्य पक्षकारों को प्रकट किया था ।

(2) जो कोई, मोटर यान का विनिर्माता होते हुए, अध्याय 7 या उसके अधीन बनाए गए नियमों और विनियमों का अनुपालन करने में असफल रहता है तो ऐसी अवधि के कारावास से जो एक वर्ष तक की हो सकेगी या ऐसे जुर्माने से जो एक अरब रुपए तक का हो सकेगा या दोनों से दंडनीय होगा ।

(3) जो कोई, किसी मोटर यान के किसी संघटक का विक्रय करता है या विक्रय करने की प्रस्थापना करता है या उसके विक्रय को अनुज्ञात करता है, जिसे केन्द्रीय सरकार द्वारा नाजुक सुरक्षा संघटक के रूप में अधिसचित किया है और जो अध्याय 7 या उसके अधीन बनाए गए नियमों और विनियमों का अनुपालन नहीं करता है ऐसी अवधि के कारावास से जो एक वर्ष तक की हो सकेगी या ऐसे जुर्माने से जो ऐसे प्रत्येक संघटक के लिए एक लाख रुपए का हो सकेगा या दोनों से दंडनीय होगा।

(4) जो कोई मोटर यान का स्वामी होते हुए, मोटर यान, किसी मोटर यान, जिसके अंतर्गत, किसी ऐसी रीति में, मोटर यान के पुों का पश्च फिटिंग करने के माध्यम भी है, का परिवर्तन करता है जो इस अधिनियम या उसके अधीन बनाए गए अधिनियमों या नियमों और विनियमों के अधीन अनुज्ञात नहीं है, ऐसी अवधि के कारावास से, जो छह मास तक की हो सकेगी या ऐसे प्रत्येक परिवर्तन के लिए पांच हजार रुपए तक के जुर्माने या दोनों से दंडनीय होगा ।
