Section 175 Motor Vehicles Act, 1988 in Hindi and English



Section 175 of MV Act 1988 :- Bar on jurisdiction of Civil Courts -- Where any Claims Tribunal has been constituted for any area, no Civil Court shall have jurisdiction to entertain any question relating to any claim for compensation which may be adjudicated upon by the Claims Tribunal for that area, and no injunction in respect of any action taken or to be taken by or before the Claims Tribunal in respect of the claim for compensation shall be granted by the Civil Court.

मोटर यान अधिनियम, 1988 की धारा 175 का विवरण :  -  सिविल न्यायालयों की अधिकारिता का वर्जन -- जहां किसी क्षेत्र के लिए कोई दावा अधिकरण गठित किया गया है वहां किसी भी सिविल न्यायालय को यह अधिकारिता न होगी कि वह प्रतिकर के किसी दावे से संबंधित किसी ऐसे प्रश्न को ग्रहण करे जिसका न्यायनिर्णयन उस क्षेत्र के लिए दावा अधिकरण द्वारा किया जा सकता है, तथा प्रतिकर के दावे की बाबत दावा अधिकरण द्वारा या उसके समक्ष की गई या की जाने वाली किसी कार्रवाई की बाबत सिविल न्यायालय कोई भी व्यादेश, मंजूर नहीं करेगा ।
